Overview
The Poultry Industry Assistance Amendment Act 1979 was enacted by the Queen and the Senate and House of Representatives of the Commonwealth of Australia to amend the Poultry Industry Assistance Act 1965. This Act was introduced to address financial adjustments and formal amendments within the existing legislative framework supporting the poultry industry. The policy objective of the 1979 Act was to ensure that the financial assistance provided to the poultry industry was updated and aligned with the economic conditions of the time, as well as to correct certain formal errors in the original Act. The amendments included updating the monetary figures and rectifying references within the Principal Act to ensure the legislation remained effective and clear.
Scope and Application
The Poultry Industry Assistance Amendment Act 1979 amends the Poultry Industry Assistance Act 1965, with the principal focus being the modification of financial provisions to better support the poultry industry. This Act applies to entities within the poultry industry that are eligible for assistance under the Principal Act. It extends its jurisdictional reach across the Commonwealth of Australia, ensuring that the amended provisions are uniformly applicable throughout the country. The Act includes amendments to the monetary contributions into the industry assistance fund, updating the amount from two hundred thousand dollars to $300,000 for the financial year commencing 1 July 1978 and subsequent years. Additionally, the Act makes several formal amendments detailed in the Schedule, which adjust references and subsections within the Principal Act to reflect the updated provisions and maintain legislative coherence. There are no stated exclusions, exemptions, or specific thresholds in the text provided, and the application of the Act is not extended or restricted through subordinate instruments within the excerpt.
Key Provisions
The Poultry Industry Assistance Amendment Act 1979 (hereafter referred to as the Amendment Act) amends the Poultry Industry Assistance Act 1965 (Principal Act) to update certain financial provisions and formalise amendments to the Principal Act. Section 3 of the Amendment Act revises the monetary contribution to be paid into the designated fund, increasing it from $200,000 to $300,000, effective from the financial year beginning 1 July 1978. This adjustment ensures that the fund has the necessary resources to support the industry as intended by the legislation.
The Amendment Act also imposes specific obligations on the parties governed by the Principal Act. These obligations include the requirement to pay the revised amount into the fund as stipulated by Section 3. Additionally, the formal amendments set out in the Schedule of the Amendment Act clarify and update references within the Principal Act, ensuring that the legislative language remains accurate and consistent with the intended operation of the Act.
Failure to comply with the obligations set out in the Amendment Act may result in legal consequences. While the Amendment Act itself does not explicitly state penalties or offences for non-compliance, breaches of the Principal Act could potentially incur penalties as prescribed by the original Act. Under the Principal Act, penalties for non-compliance could include fines, and in severe cases, criminal charges. However, the exact penalties would need to be referred to the provisions of the Principal Act for precise details.
