Overview

The Pig Slaughter Levy Regulations 1971 were enacted under the Pig Slaughter Levy Act 1971. This Act was introduced to address the need for a financial mechanism to support pig industry research and development. The Pig Slaughter Levy Act 1971 establishes a levy on the slaughter of pigs, which is intended to fund research and development activities within the pig industry. The Act was enacted by the Parliament of Australia, reflecting the policy objective of enhancing the competitiveness and efficiency of the pig industry through targeted research funding. The regulations were made pursuant to the Act, taking into account the recommendations of the Pig Industry Research Committee, which advised on the appropriate rate for the levy. These regulations specify the amount of the levy to be charged at Five cents for each pig slaughtered, effective from the first day of September 1971.

Scope and Application

The Pig Slaughter Levy Act 1971 applies to the levy imposed on the slaughter of pigs within the Commonwealth of Australia. This Act mandates that a levy, not exceeding ten cents per pig, is charged on each pig slaughtered. The Act is implemented through the Pig Slaughter Levy Regulations, which were enacted to set the levy at the rate recommended by the Pig Industry Research Committee, currently at five cents per pig. The regulations apply to all entities involved in the pig slaughtering industry within Australia, ensuring that the levy is uniformly applied across the Commonwealth. Any variations in the rate of the levy must be based on recommendations made by the Pig Industry Research Committee to the Minister, as outlined in the Act. The regulations came into effect on the first day of September 1971, and any amendments or further regulations would need to be made in accordance with the recommendations of the Pig Industry Research Committee.

Key Provisions

The Pig Slaughter Levy Regulations, which were made under the Pig Slaughter Levy Act 1971, establish a levy on pig slaughters within Australia. The levy is set at five cents for each pig slaughtered (s. 3), and these regulations came into effect on 1 September 1971 (s. 2). This levy is in line with the recommendation made by the Pig Industry Research Committee to the Minister, ensuring it does not exceed the recommended rate (s. 1(1)). These Regulations are intended to ensure that the levy is applied consistently and fairly across the industry. Entities or individuals involved in the slaughter of pigs are required to adhere to these regulations, meaning they must pay the specified levy for each pig they slaughter. This levy is to be collected by those responsible for the processing and handling of the pigs, who are expected to account for and remit the levy to the relevant authorities as stipulated by the Act. The levy serves to fund research and development activities within the pig industry, promoting its growth and sustainability. Breaching the provisions of the Pig Slaughter Levy Regulations can result in various penalties. Although the specific civil or criminal penalties for non-compliance are not detailed within these regulations, it can be inferred that failure to comply with the requirements to pay the levy could lead to fines or other legal repercussions. The exact nature and severity of these penalties would be determined by the courts or relevant authorities in accordance with the overarching Act and any additional legislation governing the enforcement of such levies.
