Overview

The Pig Slaughter Levy Collection Act 1971 was enacted to establish a framework for the collection of a levy on pigs slaughtered at abattoirs in Australia. The Act was introduced to address the need for a systematic approach to collecting this levy, ensuring compliance and accurate record-keeping. The enacting body responsible for this legislation is the Parliament of Australia. The primary policy objective of the Act is to provide a clear and efficient mechanism for the collection of the pig slaughter levy, which is likely intended to fund activities related to the pig industry, such as research, marketing, or other industry-specific initiatives. The regulations made under this Act, including the Pig Slaughter Levy Collection Regulations, outline the specific processes and requirements for levy collection, including the manner of payment, the submission of returns by abattoir proprietors, and the appointment of authorized agents to facilitate these processes.

Scope and Application

The Pig Slaughter Levy Collection Regulations 1971 apply to proprietors of abattoirs in Australia, whether situated in a state, the Australian Capital Territory, or the Northern Territory. These regulations are made under the Pig Slaughter Levy Collection Act 1971 and govern the collection of the pig slaughter levy. They require proprietors of abattoirs to pay the levy at designated Department of Primary Industry offices, submit returns and declarations regarding the number of pigs slaughtered, and maintain proper records. The regulations also permit proprietors to appoint authorized agents to execute declarations on their behalf. The scope of these regulations is national, covering all abattoirs within Australia where pigs are slaughtered, thereby ensuring consistent collection of the levy across jurisdictions.

Key Provisions

The Pig Slaughter Levy Collection Regulations, made under the Pig Slaughter Levy Collection Act 1971, provide detailed guidelines for the collection of the pig slaughter levy. Regulation 3 specifies the locations for levy payment: it must be made at the Department of Primary Industry office in the capital city of the State where the pigs were slaughtered or in Canberra for abattoirs in the Australian Capital Territory or the Northern Territory. Regulation 4 mandates that the proprietor of an abattoir must submit a return and declaration regarding the number of pigs slaughtered each month by the 28th day of the following month. This return, completed on Form 1, must be signed by the proprietor, an authorized agent, the manager, or a director or secretary of the company if the proprietor is a corporation. Regulation 5 requires the proprietor or any person causing pigs to be slaughtered to keep accurate records of the number of pigs slaughtered daily and monthly, with a penalty of two hundred dollars for failure to maintain these records. These regulations impose several obligations on the parties they govern. The proprietor of an abattoir must ensure that all required returns are submitted accurately and on time, as stipulated in Regulation 4. They must also maintain proper records as per Regulation 5. If the proprietor appoints an authorized agent to handle these tasks, they must ensure that the agent is duly appointed in accordance with Regulation 7, using Form 2, and that the agent's signature specimen is included. Any person causing pigs to be slaughtered at an abattoir owned by someone else must provide the owner with a written statement detailing the relevant information, as required by Regulation 6. Breaches of these regulations can lead to significant consequences. Regulation 5 imposes a penalty of two hundred dollars for failure to keep proper records. Failure to submit the required returns by the specified deadline, or providing false information in these returns, could potentially lead to further penalties or enforcement actions under the Pig Slaughter Levy Collection Act 1971, although specific civil or criminal penalties are not detailed in the regulations themselves. It is also worth noting that any failure to comply with these requirements could potentially impact the overall collection of the levy and may lead to administrative or legal actions to enforce compliance.
