Explanatory Statement

Statutory Rules 1983 No. 323

Phosphate Fertilizers Bounty Regulations (Amendment)

Issued by the Authority of the Minister of State for Industry and Commerce.

The Fertilizers (Subsidy) Amendment Act 1982 amended the Phosphate Fertilizers Bounty Act 1963 to, amongst other things, widen the scope of the phosphate fertilizer scheme to provide for the payment of a subsidy on both locally produced and imported fertilizers.

The purpose of the Regulations is to amend the Phosphate Fertilizers Bounty Regulations to -

  (i) bring the Regulations into line with the Principal Act as a consequence of the amendments made by the Fertilizers (Subsidy) Amendment Act 1982;

and

 (ii) update references in the Regulations to reflect administrative rearrangements.

Details of the Regulations are set out below:

Regulation 1

Changes the citation of the Phosphate Fertilizers Bounty Regulations to the Phosphate Fertilizers Subsidy Regulations to bring the title of the Regulations into line with the title of the Act.

Regulation 2

Updates, in existing regulation 2, the definition of “the Act” to be cited as the Phosphate Fertilizers Subsidy Act 1963.

Regulation 3

Omits, in existing regulation 2AA, the reference to “Department of Science and Environment” in the definition of “approved analyst” and substitutes a reference to “Department of Science and Technology”.

Regulation 4

Amends existing regulation 5 to

  (i) omit paragraph (2)(a) and adjust paragraph (2)(c) as a consequence;

 (ii) omit paragraphs (4)(b), (d), (e) and (f) which specify the particulars to be set out in an application for bounty in respect of bountiable products and substitute new paragraphs which specify the particulars to be set out in applications for subsidy in respect of subsidized goods produced in or imported into Australia.

The new paragraphs reflect the amendments made by the Fertilizers (Subsidy) Amendment Act 1982 which provides that subsidy will be payable to both domestic producers and to importers of phosphate fertilizers; and

(iii) remakes existing paragraph (4)(j) to cause the provision in that paragraph to apply to both an importer and a producer of the subsidized goods.

Regulation 5

Makes a number of minor technical amendments to the Schedule to the Regulations.

Regulation 6

Provides for other amendments of a drafting nature consequent on the amendments to be made to the Regulations as set in the Schedule.

Overview

The Phosphate Fertilizers Subsidy Regulations (Amendment) 1983, enacted by the Authority of the Minister of State for Industry and Commerce, were introduced to amend the Phosphate Fertilizers Bounty Regulations and bring them into alignment with the Fertilizers (Subsidy) Amendment Act 1982. The primary objective of these regulations is to update the existing framework to reflect the expanded scope of the phosphate fertilizer scheme, which now includes the payment of subsidies on both locally produced and imported fertilizers. This legislative change addresses the need to modernise the regulatory environment to accommodate the broadened subsidy scheme, ensuring that the regulatory framework accurately reflects the legislative intent of the 1982 amendments and accommodates administrative changes.

Scope and Application

The Phosphate Fertilizers Subsidy Regulations, as amended by the Statutory Rules 1983 No. 323, apply to all entities involved in the production and importation of phosphate fertilizers in Australia, reflecting the changes introduced by the Fertilizers (Subsidy) Amendment Act 1982. These regulations ensure that both domestic producers and importers of phosphate fertilizers are eligible for the subsidy, extending the scheme's reach to encompass both locally manufactured and imported goods. Geographically, the application of these regulations is confined to Australia, thus governing the subsidy process within the national jurisdiction. The regulations also update references to align with administrative changes, such as the substitution of "Department of Science and Technology" for "Department of Science and Environment" in the definition of an "approved analyst". Any further application or restriction of these regulations may be specified through subordinate instruments issued under the authority of the relevant minister.

Key Provisions

The Phosphate Fertilizers Subsidy Regulations (Amendment) 2004 are designed to align the existing regulations with the Phosphate Fertilizers Subsidy Act 1963 as amended by the Fertilizers (Subsidy) Amendment Act 1982. The primary changes are intended to update and clarify the regulatory framework to reflect the expanded scope of the subsidy scheme, which now includes both locally produced and imported fertilizers. Regulation 1 renames the "Phosphate Fertilizers Bounty Regulations" to "Phosphate Fertilizers Subsidy Regulations," aligning the title with the updated Act. Regulation 2 updates the definition of "the Act" in regulation 2 to refer to the "Phosphate Fertilizers Subsidy Act 1963." Regulation 3 modifies the reference in regulation 2AA, changing the Department from "Science and Environment" to "Science and Technology" in the definition of "approved analyst." Regulation 4 makes substantive changes to regulation 5, omitting certain paragraphs and substituting new ones to reflect the subsidy scheme's broader scope. Regulation 5 involves minor technical amendments to the Schedule, ensuring consistency and accuracy in the regulatory text. Lastly, Regulation 6 addresses other drafting amendments necessary to maintain coherence and clarity in the Regulations. These Regulations impose several obligations on parties involved in the production and importation of phosphate fertilizers. Manufacturers and importers of phosphate fertilizers must ensure that their applications for subsidy include the particulars specified in the amended regulation 5. This includes providing detailed information about the fertilizer products, ensuring compliance with the updated regulatory requirements. Additionally, the Regulations require that any application for subsidy must be submitted to the relevant authority within the specified timeframes and in the prescribed format, as detailed in the updated regulation 5. Importers and producers must also ensure that their records and documentation are accurate and readily available for inspection by authorized officers. Failure to comply with the requirements set out in the Phosphate Fertilizers Subsidy Regulations (Amendment) 2004 may result in civil or criminal penalties. While the Regulations do not specify the exact penalties for non-compliance, the general legislative framework under which these Regulations operate may impose fines or other sanctions. The maximum penalties would typically depend on the severity of the breach and could range from fines to potential criminal charges for serious or repeated violations. It is essential for all parties involved to understand and adhere to the updated regulatory requirements to avoid any potential legal consequences.
