Explanatory Statement

Statutory Rules 1983 No. 323

Phosphate Fertilizers Bounty Regulations (Amendment)

Issued by the Authority of the Minister of State for Industry and Commerce.

The Fertilizers (Subsidy) Amendment Act 1982 amended the Phosphate Fertilizers Bounty Act 1963 to, amongst other things, widen the scope of the phosphate fertilizer scheme to provide for the payment of a subsidy on both locally produced and imported fertilizers.

The purpose of the Regulations is to amend the Phosphate Fertilizers Bounty Regulations to -

  (i) bring the Regulations into line with the Principal Act as a consequence of the amendments made by the Fertilizers (Subsidy) Amendment Act 1982;

and

 (ii) update references in the Regulations to reflect administrative rearrangements.

Details of the Regulations are set out below:

Regulation 1

Changes the citation of the Phosphate Fertilizers Bounty Regulations to the Phosphate Fertilizers Subsidy Regulations to bring the title of the Regulations into line with the title of the Act.

Regulation 2

Updates, in existing regulation 2, the definition of “the Act” to be cited as the Phosphate Fertilizers Subsidy Act 1963.

Regulation 3

Omits, in existing regulation 2AA, the reference to “Department of Science and Environment” in the definition of “approved analyst” and substitutes a reference to “Department of Science and Technology”.

Regulation 4

Amends existing regulation 5 to

  (i) omit paragraph (2)(a) and adjust paragraph (2)(c) as a consequence;


 (ii) omit paragraphs (4)(b), (d), (e) and (f) which specify the particulars to be set out in an application for bounty in respect of bountiable products and substitute new paragraphs which specify the particulars to be set out in applications for subsidy in respect of subsidized goods produced in or imported into Australia.

The new paragraphs reflect the amendments made by the Fertilizers (Subsidy) Amendment Act 1982 which provides that subsidy will be payable to both domestic producers and to importers of phosphate fertilizers; and

(iii) remakes existing paragraph (4)(j) to cause the provision in that paragraph to apply to both an importer and a producer of the subsidized goods.

Regulation 5

Makes a number of minor technical amendments to the Schedule to the Regulations.

Regulation 6

Provides for other amendments of a drafting nature consequent on the amendments to be made to the Regulations as set in the Schedule.
