Overview

The Petroleum Resource Rent Tax (Interest on Underpayments) Act 1987 was enacted by the Parliament of Australia to address the issue of interest charges on underpayments of certain amounts payable under the Petroleum Resource Rent Tax Assessment Act 1987. This Act was designed to complement the primary legislation by imposing interest charges on underpaid amounts, thereby ensuring that the tax system remains robust and effective in collecting due taxes. The Act came into operation on the same day as the Petroleum Resource Rent Tax Assessment Act 1987, highlighting its integral role in the overall tax regime. The policy objective is to maintain the integrity of the tax collection process by ensuring that any underpayments are subject to appropriate interest charges.

Scope and Application

The Petroleum Resource Rent Tax (Interest on Underpayments) Act 1987 applies to entities or individuals who have made underpayments of certain amounts payable under the Petroleum Resource Rent Tax Assessment Act 1987. This Act is a Commonwealth statute and thus applies nationwide across Australia, imposing an interest charge on the underpaid amounts as specified. It is designed to supplement the primary legislation by ensuring that any shortfall in payments is accounted for through interest, thereby enforcing the financial obligations as stipulated by the Petroleum Resource Rent Tax Assessment Act 1987. There are no explicit exclusions, exemptions, or thresholds mentioned in the primary text of the Act itself, but the application and enforcement of these provisions may be further detailed in subordinate instruments or regulations. This Act extends its application to any entity or individual involved in the petroleum industry subject to the Petroleum Resource Rent Tax Assessment Act 1987, thereby ensuring compliance with the stipulated financial obligations.

Key Provisions

The Petroleum Resource Rent Tax (Interest on Underpayments) Act 1987 (section 3) imposes an interest charge on certain underpayments of amounts payable under the Petroleum Resource Rent Tax Assessment Act 1987. This interest is payable in accordance with section 65 of the latter Act. The primary focus of this legislation is to ensure that any shortfalls in tax payments are subject to an interest charge, thereby encouraging timely and accurate compliance with tax obligations. The Act is designed to supplement the main tax assessment Act by specifically addressing the issue of underpayments through the imposition of interest. Parties or entities governed by this Act are required to ensure that any underpayments of tax are rectified promptly and that interest charges are calculated and paid as required by section 65 of the Petroleum Resource Rent Tax Assessment Act 1987. These entities must maintain accurate records of their tax payments and be prepared to demonstrate compliance with the interest charge provisions. It is essential for these entities to adhere to the specified deadlines and payment schedules to avoid incurring additional interest charges. Failure to comply with the interest charge provisions outlined in the Petroleum Resource Rent Tax (Interest on Underpayments) Act 1987 can result in civil and criminal consequences. While the Act does not explicitly state penalties, the failure to pay the required interest charges can lead to financial penalties and legal actions. The severity of these consequences will depend on the extent of the underpayment and the resultant interest. Additionally, ongoing non-compliance may result in further legal ramifications, including potential court orders and fines. It is therefore imperative for entities subject to this Act to ensure full compliance to avoid these adverse outcomes.
