Overview

The Petroleum and Other Fuels Reporting (Acceptable Alternative Report – National Offshore Petroleum Titles Administrator) Declaration 2018 was enacted in 2018 to provide flexibility in the reporting requirements for petroleum and other fuels, as stipulated under the Petroleum and Other Fuels Reporting Rules 2017. This declaration was made by I, Josh Frydenberg, Minister for the Environment and Energy, aiming to address the need for alternative reporting formats that still meet regulatory standards. The enacting body responsible for this declaration is the Parliament of Australia, with the primary policy objective being to streamline reporting processes while maintaining compliance with existing regulations. The declaration itself specifies that a monthly production report is considered an acceptable alternative report for January 2018 onwards, provided it adheres to the requirements set out in regulation 7.19 of the Offshore Petroleum and Greenhouse Gas Storage (Resource Management and Administration) Regulations 2011. This approach allows for a more adaptable reporting framework, ensuring that industry stakeholders can meet their obligations in a manner that is both efficient and compliant with regulatory standards.

Scope and Application

The Petroleum and Other Fuels Reporting (Acceptable Alternative Report – National Offshore Petroleum Titles Administrator) Declaration 2018 is a legislative instrument that pertains to the Petroleum and Other Fuels Reporting Rules 2017. Specifically, it declares that a monthly production report is recognised as an acceptable alternative report under the Rules if it is given in accordance with regulation 7.19 of the Offshore Petroleum and Greenhouse Gas Storage (Resource Management and Administration) Regulations 2011. This declaration applies to entities involved in the offshore petroleum industry, including operators of national offshore petroleum titles. The geographic reach of the Act extends to all offshore areas within Australia's jurisdiction where petroleum activities are regulated. The instrument commenced on the day after it was registered, as specified in the table within the legislation. The Act does not explicitly mention any exclusions, exemptions, or thresholds, and its application is not extended or restricted through subordinate instruments.

Key Provisions

The Petroleum and Other Fuels Reporting (Acceptable Alternative Report – National Offshore Petroleum Titles Administrator) Declaration 2018 outlines the parameters under which a monthly production report can be considered an acceptable alternative report. According to section 5 of the instrument, a monthly production report is deemed acceptable if it complies with regulation 7.19 of the Offshore Petroleum and Greenhouse Gas Storage (Resource Management and Administration) Regulations 2011. This declaration is made for the purposes of paragraph 19(1)(c) of the Petroleum and Other Fuels Reporting Rules 2017, and it applies to reports for January 2018 or any subsequent calendar month. Under section 2 of the instrument, all provisions of the Declaration commence the day after it is registered. This commencement clause ensures that the declaration takes effect immediately upon registration, providing clarity on the timing of its application. It is important to note that any information in column 3 of the table is not part of the instrument, and any inserted or edited information in this column will not affect the legal standing of the instrument. The obligations imposed by the Declaration are primarily on entities required to submit monthly production reports. These entities must ensure that their reports comply with regulation 7.19 of the Offshore Petroleum and Greenhouse Gas Storage (Resource Management and Administration) Regulations 2011 to be considered acceptable alternatives. This requirement ensures that the reports meet the necessary standards for reporting under the Petroleum and Other Fuels Reporting Rules 2017. In terms of penalties and consequences, the Declaration does not explicitly outline specific offences or penalties for non-compliance. However, entities that fail to submit acceptable alternative reports as declared may face consequences under the broader regulatory framework of the Petroleum and Other Fuels Reporting Rules 2017. Non-compliance could potentially lead to enforcement actions, fines, or other penalties as prescribed by the overarching legislation. The maximum penalties would be determined by the relevant provisions of the Petroleum and Other Fuels Reporting Rules 2017.
