Patents Regulations (Amendment)

The Statutory Rules amend the Patents Regulations (the Regulations) to update the list of prescribed employees for the purposes of subsection 209(1) of the Patents Act 1990 (the Act).

Details of the amendments made by these Statutory Rules are as follows:

Regulation 1 identifies the Patents Regulations as those to be amended.

Regulation 2 deletes from subregulation 5.1 (a)(iii) a reference to regulation 9.5('completion of re-examination').

Regulation 3 substitutes existing Schedule 6A with a new Schedule 6A with the effect that, under regulation 21.2, "prescribed employees" for the purposes of subsection 209(1) of the Act will be those listed in the new Schedule.

Regulation 4 inserts a new fee item into Part 3 of Schedule 7 allowing the Commissioner to charge late fees under Rule 16bis of the Patent Cooperation Treaty.
