Overview

The Passenger Movement Charge Amendment Act 2024, assented to on 8 March 2024 by the Parliament of Australia, serves to modify the Passenger Movement Charge Act 1978, aiming to address certain gaps and issues within the existing framework. The primary purpose of this Act is to adjust the passenger movement charge imposed on international departures from Australia, reflecting changes in economic conditions and operational costs within the aviation sector. This legislative update ensures that the charge remains aligned with current financial realities, thereby maintaining the sustainability of the aviation infrastructure and services that support international travel. The Act is designed to take effect from 1 July 2024, affecting passengers departing on or after this date unless they have already purchased their tickets prior to the commencement date. This amendment reflects a policy objective to provide clarity and predictability in the charges levied on international passengers, ensuring that the financial burden is fair and consistent with the evolving operational environment of the aviation industry. The changes outlined in this Act are intended to streamline the application of the passenger movement charge, ultimately supporting the broader economic and operational goals of the Australian government in managing international passenger traffic.

Scope and Application

The Passenger Movement Charge Amendment Act 2024 is a legislative measure designed to modify the existing Passenger Movement Charge Act 1978. This amendment applies to the charge levied on the departure of individuals from Australia and sets a new charge amount of $70, effective from 1 July 2024. The Act specifically pertains to the departure of individuals who leave Australia on or after the commencement date, unless their travel was booked prior to this date through a ticket or equivalent authority issued before 1 July 2024. The amendment does not affect passengers whose travel arrangements were finalised before the new charge took effect. The Act's jurisdictional reach is national, applying uniformly across Australia, and it does not introduce any exclusions, exemptions, or thresholds beyond the specified conditions for ticket issuance dates. The amendment is direct, with no extensions or restrictions through subordinate instruments, as all changes are encapsulated within the Act itself.

Key Provisions

The Passenger Movement Charge Amendment Act 2024 amends the Passenger Movement Charge Act 1978 by altering the charge imposed on departing passengers. Specifically, section 6 of the 1978 Act is amended to reduce the charge from its previous rate to $70 for each person departing Australia (Schedule 1, item 1). This amendment applies to the departure of persons on or after 1 July 2024, unless the ticket or equivalent authority for the journey was sold or issued before this date (Schedule 1, item 1(a) and (b)). This Act imposes obligations on carriers and travellers. Carriers are required to ensure that any departure from Australia on or after 1 July 2024 is subject to the new charge of $70, unless the ticket or equivalent authority was sold or issued prior to this date. Travellers need to be aware of this charge if they are departing on or after 1 July 2024, and carriers must communicate this change to their customers. Failure to comply with the provisions of this Act may result in civil or criminal penalties, although the specific penalties are not detailed in the text provided. Generally, non-compliance with charges and fees mandated by the Passenger Movement Charge Act 1978 could lead to fines or other legal consequences as stipulated in the principal Act or other relevant legislation. The exact nature and extent of these penalties would typically be found in the Passenger Movement Charge Act 1978 or other associated regulatory frameworks.
