Overview

The Parliamentary Service (Remuneration) Amendment (Secretary, Department of Parliamentary Services) Determination 2022 was enacted to amend the remuneration of the Secretary of the Department of Parliamentary Services, reflecting adjustments recommended by the Remuneration Tribunal. This amendment determination was made by the Speaker of the House of Representatives and the President of the Senate, under the authority granted by subsection 63(1) of the Parliamentary Service Act 1999, and it commenced on 1 July 2022. The objective of this amendment is to ensure that the remuneration of the Secretary aligns with the recommendations of the Remuneration Tribunal, thereby maintaining fair and competitive compensation within the public sector.

Scope and Application

The Parliamentary Service (Remuneration) Amendment (Secretary, Department of Parliamentary Services) Determination 2022 amends the remuneration of the Secretary of the Department of Parliamentary Services, aligning it with the decisions made by the Remuneration Tribunal. This determination applies specifically to the Secretary of the Department of Parliamentary Services, a key administrative role within the Australian federal parliamentary system. It affects the salary and total remuneration of this individual, establishing the base salary at $318,910 and the total remuneration at $455,560 per annum, effective from 1 July 2022. The amendment repeals and replaces the previous clause from the Parliamentary Service Determination Number 1 of 2015, ensuring that the Secretary's remuneration is in line with the latest tribunal advice. The determination does not extend to other roles or entities within the parliamentary service, nor does it impact other federal, state, or territory jurisdictions.

Key Provisions

The Parliamentary Service (Remuneration) Amendment (Secretary, Department of Parliamentary Services) Determination 2022 introduces specific amendments to the remuneration of the Secretary of the Department of Parliamentary Services, as outlined in Clause 2.1 (2). The Secretary will now be eligible for a base salary of $318,910 and total remuneration of $455,560 per annum, replacing the previous arrangements set out in Clause 2.1 of Parliamentary Service Determination Number 1 of 2015. The Act imposes specific obligations on the Secretary, the Department of Parliamentary Services, and relevant stakeholders. The Secretary must ensure that their remuneration aligns with the new provisions as stipulated in Clause 2.1 (2). The Department of Parliamentary Services must also ensure that the necessary administrative and financial adjustments are made to reflect the changes in remuneration. The obligation extends to ensuring that all relevant records and documentation accurately reflect the new remuneration rates. Breach of the provisions outlined in this determination could lead to legal consequences. Although the Act does not explicitly state the penalties for non-compliance, failure to adhere to the remuneration provisions could result in legal disputes or challenges to the validity of the Secretary's appointment and remuneration. The consequences of such breaches could include financial penalties, legal costs, and potential implications for the Secretary’s employment contract and the department’s financial planning. The determination does not specify particular offences, penalties, or consequences for non-compliance within its text, but the general legislative framework under which it operates may impose sanctions. If the provisions are not followed, it could lead to legal action under the broader Parliamentary Service Act 1999, where penalties might include fines or other civil remedies. It is essential for all parties involved to comply with the new remuneration rates to avoid any legal repercussions.
