This amendment determination, made under section 38E of the Parliamentary Service Act 1999, sets the base salary and total remuneration for the Parliamentary Librarian, effective from 1 July 2017. The determination was made by the President of the Senate and the Speaker of the House of Representatives following advice from the Remuneration Tribunal. Key Provisions
The key operative sections of this determination, under the Parliamentary Service (Remuneration) Amendment (Parliamentary Librarian) Determination 2017, set forth the new remuneration and conditions of appointment for the Parliamentary Librarian (Clause 2.1). This clause replaces the previous clause to establish the base salary at $269,370 per annum and total remuneration at $304,160 per annum. This determination comes into effect from 1 July 2017, as stipulated in section 1. The authority to make this determination is derived from section 38E of the Parliamentary Service Act 1999, and it was made after receiving advice from the Remuneration Tribunal, as required by subsection 38E(1) of the Act.
The Act imposes specific obligations and requirements on the parties it governs. The President of the Senate and the Speaker of the House of Representatives are responsible for making this determination after considering the advice from the Remuneration Tribunal. This ensures that the remuneration and conditions of appointment for the Parliamentary Librarian are fair and in line with the advice provided by the tribunal. The President of the Senate and the Speaker of the House of Representatives must also ensure that the new remuneration rates, as outlined in Clause 2.1, are implemented effectively and that the Parliamentary Librarian's employment conditions are updated accordingly.
There are no explicit offences, penalties, or civil/criminal consequences outlined in this determination for breach of its provisions. However, failure to adhere to the remuneration and conditions of appointment as specified in Clause 2.1 could potentially lead to legal challenges or disputes. It is essential for the parties governed by this Act to ensure compliance with the new rates to avoid any potential legal issues. The determination itself does not specify maximum penalties for non-compliance, but any breaches may be subject to the general provisions of the Parliamentary Service Act 1999 or other relevant legislation.
