Overview
The Parliamentary Allowances Regulations, 1955, were enacted under the Parliamentary Allowances Act 1952 to ensure that specific regulations regarding the allowances for members of the House of Representatives were clearly outlined and implemented. This legislative instrument was introduced to address the need for precise definitions and adjustments to allowances for members of the House of Representatives, particularly in light of the Commissioner of Taxation's reports. The regulations were created by the Governor-General in Council, acting on advice from the Prime Minister, and the objective was to specify the allowance for the member of the House of Representatives for the Electoral Division of Forrest, reflecting the need for tailored allowances based on the electoral division.
Scope and Application
The Parliamentary Allowances Regulations, made under the Parliamentary Allowances Act 1952, specify the allowance payable to the member of the House of Representatives for the Electoral Division of Forrest. These regulations apply to the member representing the Electoral Division of Forrest and are designed to ensure that they receive a specified yearly allowance for the expenses incurred in discharging their duties. This regulation has a national reach as it pertains to the federal parliament, specifically affecting one member of the House of Representatives. The regulations do not explicitly mention exclusions or exemptions, but they are limited in scope to the particular member and electoral division in question. The allowance is set at a yearly rate of Seven hundred and fifty pounds, as per the regulations, and this rate is deemed to have come into effect from the first day of July, 1954. The allowance is subject to the broader provisions and any amendments made to the Parliamentary Allowances Act 1952, and can potentially be adjusted through subordinate instruments.
Key Provisions
The Parliamentary Allowances Regulations specify the allowance that a member of the House of Representatives for the Electoral Division of Forrest shall receive. Specifically, section 2(1) of the Regulations states that the yearly rate of this allowance is set at Seven hundred and fifty pounds. This regulation came into operation on 1 July 1954, as indicated in section 2(2). These provisions outline the financial support provided to members of the House of Representatives for the Electoral Division of Forrest, ensuring they receive a specific allowance to cover their expenses related to their duties.
The Regulations impose certain obligations on the parties involved. For instance, the Governor-General, acting on the advice of the Federal Executive Council, is responsible for making these regulations. Furthermore, the Commissioner of Taxation is tasked with reporting to the Prime Minister, which in this instance, pertains to the allowance payable to the member for the Electoral Division of Forrest. These roles and responsibilities are crucial in ensuring the proper administration and enforcement of the allowances provided under the Parliamentary Allowances Act 1952.
In terms of consequences for breach, the legislation does not explicitly outline offences, penalties, or civil or criminal consequences within the provided text. However, it is understood that breaches of regulations made under the Parliamentary Allowances Act 1952 could potentially lead to administrative or legal actions depending on the nature and severity of the breach. Typically, such breaches might result in financial penalties or corrective actions to ensure compliance with the stipulated allowances and regulations.
