Overview

Statutory Rules 1978 No. 92, made under the Papua New Guinea (Staffing Assistance) Act 1973, addresses the need to update superannuation provisions for Australian personnel providing staffing assistance to Papua New Guinea. Enacted by the Governor-General on the advice of the Federal Executive Council, these regulations seek to amend the existing superannuation scales to reflect updated financial circumstances and ensure that personnel are adequately compensated. The policy objective is to maintain equitable and fair compensation structures that align with the economic context of the time, thereby supporting the ongoing staffing assistance efforts between the two nations.

Scope and Application

The Papua New Guinea (Staffing Assistance) (Superannuation) Regulations 1978, made under the Papua New Guinea (Staffing Assistance) Act 1973, apply to individuals and entities involved in the provision of staffing assistance to Papua New Guinea, specifically relating to superannuation payments. These regulations adjust the scale of units of pension for the period from 1 September 1977 to 1 March 1978 and beyond, impacting the amount of superannuation that is to be paid during these timeframes. The amendments are designed to ensure that the superannuation benefits are aligned with the cost of living adjustments and other relevant economic factors. The regulations are applicable across the Commonwealth of Australia and extend to any person or entity providing staffing assistance to Papua New Guinea. While the regulations themselves do not explicitly state exclusions, exemptions, or thresholds, they may be subject to further clarification or limitation through subordinate instruments or interpretations made by relevant authorities.

Key Provisions

The key provisions of the regulation, detailed in Statutory Rules 1978 No. 92, involve amendments to the Papua New Guinea (Staffing Assistance) (Superannuation) Regulations. Specifically, section 10 of the regulation alters the scale of units of pension, which pertains to superannuation payments (section 10(4)). The amendment involves omitting certain monetary values and substituting new values for specific periods. For example, paragraph (e) now applies to the period from 1 September 1977 to 21 December 1977, with a value of $16,510, while paragraph (f) applies to the period from 22 December 1977 to 1 March 1978, with a value of $16,770. Paragraph (g) pertains to periods after 1 March 1978, with a value of $16,900. These amendments impose obligations on entities or individuals responsible for calculating and disbursing superannuation payments in accordance with the updated scale. The revised scale necessitates adjustments to ensure that superannuation contributions and benefits are calculated correctly for the specified periods. This may involve updating internal systems, recalculating past payments, and ensuring that future payments align with the new values stipulated in the regulation. The regulation does not explicitly outline specific offences, penalties, or consequences for non-compliance. However, given the context of the Papua New Guinea (Staffing Assistance) Act 1973 and the associated regulations, non-compliance with these provisions could potentially lead to legal consequences. This might include administrative penalties, financial penalties, or legal action for failure to adhere to the mandated superannuation scales. The exact penalties would depend on the specific provisions of the Papua New Guinea (Staffing Assistance) Act 1973 and any related legislation or regulations.
