Overview

The Statutory Rules 1977 No. 145, enacted under the Papua New Guinea (Staffing Assistance) Act 1973, aims to address the need for regular updates to the superannuation provisions for staff working in Papua New Guinea. This regulation was introduced by the Governor-General of the Commonwealth of Australia, acting on the advice of the Federal Executive Council. The primary objective is to ensure that the prescribed amounts for superannuation reflect the current economic conditions and are aligned with the specified periods as outlined in the amended regulation. This legislative instrument updates the scale of units of pension, ensuring that the benefits provided to the staff are commensurate with the economic circumstances of the time, thereby maintaining the efficacy and fairness of the superannuation scheme.

Scope and Application

The Regulation made under the Papua New Guinea (Staffing Assistance) Act 1973 pertains to the modification of superannuation provisions for personnel involved in staffing assistance to Papua New Guinea. This regulation applies to individuals who are providing staffing assistance to Papua New Guinea, and it is specifically concerned with the calculation of superannuation benefits for those personnel. The geographic reach of this legislation is limited to personnel engaged in staffing assistance within Papua New Guinea, and it is enforced within the Commonwealth of Australia. There are no explicit exclusions or thresholds stated in the text, but the regulation does specify particular periods with different prescribed amounts for the calculation of superannuation units. The regulation also indicates that further amendments and detailed provisions are available in the referenced statutory rules and regulations, suggesting that the scope and application of this Act might be extended or refined through subordinate instruments.

Key Provisions

The main operative sections of this regulation pertain to the amendment of the Papua New Guinea (Staffing Assistance) (Superannuation) Regulations, specifically concerning the scale of units of pension (Regulation 10(4)). This section modifies the prescribed amounts for certain periods, updating the pension scale to reflect the changes in economic conditions from August 1976 to May 1977. The regulation introduces new amounts for pensions payable for specified periods, replacing the previous sub-regulation (4) with updated financial values. This change is intended to ensure that superannuation payments are adjusted in line with inflation and other economic factors over the specified time frames. This Act imposes specific obligations on the parties involved in the administration of superannuation payments. For instance, it mandates that the relevant authorities must calculate and pay superannuation benefits in accordance with the new scale of units specified in the amended regulation. The authorities must ensure that all relevant records and calculations reflect these new amounts to avoid discrepancies in pension payments. Additionally, the regulation requires that any changes to the scale of units be communicated clearly to all stakeholders, including employees and superannuation funds, to maintain transparency and accuracy in the payment process. Breach of the obligations set out in this regulation can result in serious consequences. While the regulation itself does not explicitly outline specific offences or penalties, it is reasonable to infer that failure to comply with the updated scale of units could lead to financial discrepancies, disputes, or even legal challenges from affected parties. Such breaches may be subject to scrutiny and corrective actions by relevant oversight bodies, potentially leading to financial penalties, legal proceedings, or other administrative actions. The precise consequences would depend on the specific context and the severity of the non-compliance, but the regulation underscores the importance of adherence to the updated scale of units to maintain the integrity of superannuation payments.
