EXPLANATORY STATEMENT

STATUTORY RULE 1982 NO 353

Issued by the Authority of the Minister for Communications

It is provided in Sub-section 7 of Section 18 of the Overseas Telecommunications Act 1946, that the rate of salary of an officer of the Overseas Telecommunications Commission (Australia) (other than the General Manager) shall if it exceeds the prescribed rate, be subject to the approval of the Minister for Communications.

Regulation 8A of the Overseas Telecommunications Commission Regulations provides that the prescribed rate is the higher of the following rates:

(a) the rate of $35,300 per annum;

(b) the highest rate per annum in the scale of rates specified in respect of the office of Engineer, Class 5, in the Third Division of the Australian Public Service (Salaries) Regulations as in force at the time the Commission makes its salary determination.

The purpose of this Statutory Rule is to amend the existing rate prescribed in paragraph (a) of Regulation 8A to $37,770 per annum.

Overview

The Statutory Rule 1982 No. 353, issued under the authority of the Minister for Communications, amends the Overseas Telecommunications Act 1946 to adjust the prescribed salary rate for officers of the Overseas Telecommunications Commission (Australia). Enacted to address the need for updating the salary threshold set out in the legislation, this amendment ensures that the prescribed rate remains in line with current remuneration standards. The purpose of this change is to reflect the evolving economic context and to maintain the integrity of the salary structure within the Australian Public Service. The policy objective of this Statutory Rule is to update the prescribed salary rate specified in Regulation 8A of the Overseas Telecommunications Commission Regulations, aligning it with the highest rate for an Engineer, Class 5, in the Third Division of the Australian Public Service (Salaries) Regulations. This amendment ensures that the salaries of relevant officers are appropriately benchmarked against contemporary standards, thereby supporting the efficient functioning of the Overseas Telecommunications Commission.

Scope and Application

The Overseas Telecommunications Act 1946, as amended by Statutory Rule 1982 No 353, applies to officers of the Overseas Telecommunications Commission (Australia) who are not the General Manager. Specifically, the Act concerns the salaries of these officers, stipulating that any salary exceeding a certain prescribed rate must be approved by the Minister for Communications. The prescribed rate, as amended, is set at the higher of either $37,770 per annum or the highest rate per annum specified in the scale for Engineers, Class 5, in the Third Division of the Australian Public Service (Salaries) Regulations. This Act has a Commonwealth reach, impacting the federal level of governance in Australia. Notably, the Act does not specify any exclusions or exemptions, meaning that all officers of the Commission, other than the General Manager, are subject to its provisions. The application of the Act is further detailed in subordinate instruments, such as the Overseas Telecommunications Commission Regulations, which provide additional context and enforcement mechanisms for the stipulated salary rates.

Key Provisions

The main operative sections of this Statutory Rule pertain to the amendment of the prescribed rate for the salary of officers of the Overseas Telecommunications Commission (OTC), as detailed in Section 18(7) of the Overseas Telecommunications Act 1946 (hereafter referred to as the Act) and Regulation 8A of the Overseas Telecommunications Commission Regulations. The Act stipulates that the salary of an OTC officer, excluding the General Manager, must be approved by the Minister for Communications if it surpasses a prescribed rate. Regulation 8A sets the prescribed rate as the higher of two specified amounts: either $35,300 per annum or the highest rate per annum for an Engineer, Class 5, in the Third Division of the Australian Public Service (Salaries) Regulations. This Statutory Rule increases the first specified amount to $37,770 per annum. The Act imposes specific obligations on the OTC in relation to the salaries of its officers. It mandates that any officer whose salary exceeds the prescribed rate must have their remuneration approved by the Minister for Communications. This requirement ensures that the salaries of OTC officers are consistent with government policies and standards. Regulation 8A further specifies the method for determining the prescribed rate, ensuring transparency and consistency in salary determinations. Breach of the salary provisions outlined in the Act and the regulations can result in significant consequences. Although the Statutory Rule itself does not explicitly detail penalties for non-compliance, the overarching framework of the Act and the associated regulations implies that failure to adhere to the prescribed salary rates could lead to legal action. Such action might include orders for salary adjustments or other remedial measures to ensure compliance with the statutory and regulatory requirements. Given the nature of the provisions, non-compliance could also result in reputational damage for the OTC and potential scrutiny from the Minister for Communications and relevant oversight bodies.
