EXPLANATORY STATEMENT
STATUTORY RULES NO 352
OVERSEAS STUDENTS CHARGE REGULATIONS (AMENDMENT)
ISSUED BY THE AUTHORITY OF THE MINISTER FOR EDUCATION
Section 8 of the Overseas Students Charge Act 1979 (the Act) provides that the Governor-General may make regulations for the purposes of any provision of the Act.
Section 6 of the Act provides that the amount of the charge imposed by the Act in respect of the enrolment of an overseas student in a prescribed course for a year is such amount, not exceeding $3,565 for students who commenced a prescribed course prior to 1 January 1986 and not exceeding $4,340 for students who commence a prescribed course for the first time from 1 January 1986, as is applicable under the regulations to that enrolment. These maximum amounts provided for by the Act were recently increased from $3,350 by the Overseas Students Charge Amendment Act 1985. (Act No. 155 Assented to 5 December 1985.
The amending regulations increase the overseas students charge to the level announced by the Government in the House of Representatives on 20 November 1985.
Regulation 1 provides for the new amendments to come into operation on 1 January 1986.
Regulation 2 amends the Overseas Students Charge Regulations as follows:
• under existing paragraph 3(1) the charges in respect of a student enrolled in the following courses are:
| 3(1) (a) | a master’s degree or doctorate | - $3,350 |

| 3(1) (b) | a course of study in medicine, |
|
|
|
| veterinary science or dentistry | - $3,100 |
|
| 3(1) (c) | in any other course | - $2,500 |
|
• The amendment will increase the charges to the following levels:
(a) in respect of a student who is enrolled in a prescribed course that commenced before 1 January 1986 and ends in a year after that date -
(i) in the case of a student who is enrolled in a course of study in medicine, veterinary science or dentistry - $3,565; and
(ii) in any other case - $2,875.
From 1 January 1986 postgraduate students will pay the same charge as undergraduates in their faculty.
(b) in respect of a student who enrols in a prescribed course that commences on or after 1 January 1986 -
(i) in the case of a student who is enrolled in a course of study in medicine, veterinary science or dentistry - $4,340; and
(ii) in any other case - $3,500.
Regulation 3 will amend the Overseas Students Charge Regulations by inserting a new regulation 3A which will set the charge at the amount referred to in sub-paragraph 3(1) (a) (i) or (ii), as the case requires, for a student who was enrolled in a prescribed course before 1 January 1986, who transfers from one course to another or whose enrolment in a prescribed course was interrupted by a period of deferment approved by the institution offering the course, and the enrolment is resumed in accordance with the terms of the approval.
Section 4A of the Act provides that the regulations may specify a course of study offered or to be offered by a specified educational institution (other than a prescribed educational institution, that is, a university or college of advanced education) to be a declared course for the purposes of the Act. Declared courses are those which, while fully Commonwealth funded, and accredited at advanced education level, are offered in an institution other than a university or college of advanced education.
Declared courses are listed in the Schedule to the Overseas Students Charge Regulations (the Regulations). Under section 5 of the Act, an overseas student enrolled in a prescribed course (including, inter alia, a declared course - section 4 of the Act) for a year is liable for a charge in respect of that enrolment.
Commonwealth funded advanced education level courses to be offered in other than universities and colleges of advanced education in 1986 will differ from those offered in 1985. The purposes of the amending regulation is to reflect those differences.
Regulation 4 repeals the existing Schedule of Declared courses and substitutes a revised schedule. Part I of the Schedule lists full-time courses, and part II lists courses which involve part-time study. A copy of the Schedule is attached.
