Order to Establish the National Commission for Aboriginal and Torres Strait Islander Children and Young People as an Executive Agency

I, the Honourable Sam Mostyn AC, Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council and under section 65 of the Public Service Act 1999:

1.       establish the National Commission for Aboriginal and Torres Strait Islander Children and Young People as an Executive Agency; and

1.       allocate the name National Commission for Aboriginal and Torres Strait Islander Children and Young People to the Executive Agency; and

1.       allocate the name National Commissioner to the Head of the Executive Agency; and

1.       identify the Minister for Social Services as the Minister responsible for the Executive Agency;

1.       specify the functions of the Executive Agency to be as follows:

1.       promote and protect the rights of Aboriginal and Torres Strait Islander children and young people through strategic policy advice and reports to Government on matters affecting Aboriginal and Torres Strait Islander children and young people, and their families;
2.       provide advice to Government on and inform the implementation of key policy frameworks which seek to improve outcomes for Aboriginal and Torres Strait Islander children and young people and their families;
3.       promote and enhance coordination across Commonwealth and state and territory governments, commissioners, guardians and advocates and non-government organisations on matters related to Aboriginal and Torres Strait Islander Children and Young people;
4.       undertake consultation with Aboriginal and Torres Strait Islander children and young people and their families, relevant Commonwealth and state and territory governments, commissioners, guardians and advocates and non-government organisations;
5.       ensure the voices of Aboriginal and Torres Strait Islander children and young people and their families are reflected in advice to Government.

This Order will commence on 13 January 2025.
