Part 1—Preliminary

1  Name

  This instrument is the Offshore Petroleum and Greenhouse Gas Storage (Approved Forms) Notifiable Instrument 2026.

2  Commencement

 (1)  Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

Note: This table relates only to the provisions of this instrument as originally made. It will not be amended to deal with any later amendments of this instrument.

 (2) Any information in column 3 of the table is not part of this instrument. Information may be inserted in this column, or information in it may be edited, in any published version of this instrument.

3  Authority

  This instrument is made under the Offshore Petroleum and Greenhouse Gas Storage Act 2006.

4  Definitions

  In this instrument:

Act means the Offshore Petroleum and Greenhouse Gas Storage Act 2006.

Part 2—Approval of forms

5  Form for instrument of transfer (petroleum titles)

Under subsection 474(4) of the Act, the form approved for an instrument of transfer for the purposes of paragraph 474(1)(b) of the Act, is the form at Schedule 1.

6  Form for Supplementary instrument to accompany application for approval of a dealing (petroleum titles)

Under subsection 489(5) of the Act, the form approved for a supplementary instrument to accompany an application for approval of dealing for the purposes of subsection 489(2) of the Act, is the form at Schedule 2.

7  Form for instrument of transfer (greenhouse gas titles)

Under subsection 526(4) of the Act, the form approved for an instrument of transfer for the purposes of paragraph 526(1)(b) of the Act, is the form at Schedule 3.

8  Form for supplementary instrument to accompany application for approval of a dealing (greenhouse gas titles)

Under subsection 540(4) of the Act, the form approved for a supplementary instrument to accompany an application for approval of a dealing for the purposes of subsection 540(2) of the Act, is the form at Schedule 4.

Schedule 2— Approved form – Supplementary Instrument to accompany application for Approval of a Dealing (Petroleum Titles)

Supplementary instrument to accompany an application for approval of dealing under subsection 489(2) of the Offshore Petroleum and Greenhouse Gas Storage Act 2006 (the OPGGS Act).

1.     Insert the full name of the dealing as shown on the instrument.
2.     Insert the date the instrument evidencing the dealing was executed.
3.     Insert the title number to which the dealing relates e.g., WA-1-P.‑1-P.
4.     Insert the title type to which the dealing relates e.g., Petroleum Exploration Permit.
5.     List the full name, ACN, ARBN or foreign equivalent; and business address of each party to the dealing as specified on the of the instrument.

Note: where the parties to the dealing have been amended by subsequent dealings, also list the full name, ACN, ARBN or foreign equivalent; and business address of the current parties to the dealing.

1.     Provide a plain English description of the specific action(s) of the dealing in relation to the title.
2.     Provide details of the effect(s) of the dealing (upon registration), specified in terms of the relevant item in the table in section 486 of the OPGGS Act. e.g., The dealing has the effect set out in item 1 of the table in section 486 of the OPGGS Act, being the creation or assignment of an interest in an existing title.
3.     List all titleholders and parties to the dealing.
4.     Provide details of the percentage (%) interests in the title of all parties to the dealing and titleholders before registration of the dealing. Percentage (%) interests in the title must total 100%.

Note: if a party to the dealing has no interests in the title reflect this as 0%.

1.   Provide details of the what the percentage (%) interest(s) in the title of all parties to the dealing and titleholders will be if registration of the dealing occurs or state ‘No Change’. Percentage (%) interests in the title must total 100%.
2.   Indicate whether a transfer of title has or will be submitted to give effect to any change in interests reflected in the dealing.
3.   Provide details of any related dealing including dealing name, executed date, approved date and registration number (if any) and a brief description of how it is a related dealing.

Related dealing means a dealing executed, before the execution of the instrument evidencing the dealing, by some or all of the parties to that instrument:

(a) that affects the title which is the subject of the dealing to which the instrument relates; and

that:

(i) creates or assigns an option to enter into the dealing; or

(ii) creates or assigns a right to enter into the dealing; or

(ii) is altered or terminated by the dealing;

and includes any transaction in respect of which an instrument was registered under section 81 of the Petroleum (Submerged Lands) Act 1967 before 22 July 1985.

Note: Please ensure that all related dealings have been registered against the title or that an application for approval has been lodged.
