Minute No. 33 of 1991 - Treasurer

Subject - Occupational Superannuation Standards Act 1987

Occupational Superannuation Standards Regulations (Amendment)

Section 22 of the Occupational Superannuation Standards Act 1987 (the Act) provides that the Governor-General may make regulations for the purposes of the Act, and, in particular, to prescribe methods for determining whether an eligible termination payment, superannuation pension or annuity is within or exceeds the reasonable benefit limits.

Part IIIA of the Act, which commenced on 1 July 1990, established arrangements for the administration of the reasonable benefit limits. Coinciding with the commencement of Part IIIA, the Occupational Superannuation Standards Regulations were amended by inserting Part IA to prescribe the method by which Insurance and Superannuation Commissioner (the Commissioner) determines a person's reasonable benefit limit and whether a benefit received by a person is within or in excess of that limit.

The amended Regulations have amended certain regulations by substituting a new effective date and also corrected an ambiguity in Schedule 3. This ambiguity had been identified both by the Insurance and Superannuation Commissioner and the Superannuation Industry.

The amendments are described in detail in the attachment.

These Regulations will commence on the date of Gazettal.

Overview

The Occupational Superannuation Standards Regulations (Amendment) 1991 No. 458 was introduced to amend the existing Occupational Superannuation Standards Regulations, primarily to address ambiguities and update effective dates as required by the Occupational Superannuation Standards Act 1987. This Act was enacted to establish standards for occupational superannuation and to provide for the administration of superannuation benefits, particularly in relation to reasonable benefit limits. The amendments were made under the authority granted by Section 22 of the Occupational Superannuation Standards Act 1987, with the objective of ensuring clarity and accuracy in the regulation of superannuation benefits. The Regulations were enacted by the Australian Parliament and will commence on the date of Gazettal, providing updated guidance on the effective dates for various provisions and correcting an ambiguity identified by the Insurance and Superannuation Commissioner and the Superannuation Industry.

Scope and Application

The Occupational Superannuation Standards Regulations (Amendment) 1991 No. 458 pertains to amendments made to the Occupational Superannuation Standards Regulations in order to align them with the provisions of the Occupational Superannuation Standards Act 1987. The Act applies to all entities and individuals involved in occupational superannuation arrangements in Australia, including trustees, members, employers, and superannuation funds. The Regulations are made under the authority of Section 22 of the Act and are intended to prescribe methods for determining whether an eligible termination payment, superannuation pension, or annuity is within or exceeds the reasonable benefit limits established by the Act. The Regulations are applicable on a national level, covering all states and territories within Australia. The amendments correct and clarify various provisions within the principal regulations, including updating effective dates and rectifying a typographical error, with the overarching aim of ensuring compliance with the Act and improving the administration of superannuation benefits. The Regulations will commence on the date of their publication in the Gazette.

Key Provisions

The Occupational Superannuation Standards Regulations (Amendment) 1991 No. 458 amends various provisions of the Occupational Superannuation Standards Regulations to address certain ambiguities and update effective dates. Specifically, Regulation 1 provides the overarching amendment to the regulations. Regulation 2 updates several subregulations with new effective dates, as detailed in subregulations 2.1 to 2.6. Regulation 3 also changes the effective date for paragraph 4L(1)(c) of the principal regulations. Regulation 4 corrects a typographical error in Subregulation 4N(1). Regulation 5 updates several subregulations with new effective dates, as detailed in subregulations 5.1 to 5.5. Regulation 6 updates the effective date for subregulations 4ZB(1) and 4ZB(2). Finally, Regulation 7 replaces Schedule 3 to remove an ambiguity in relation to a person's age for the purposes of that schedule. These amendments impose specific obligations on the parties governed by the regulations. They require entities to adhere to the new effective dates specified for various provisions. The corrections and clarifications, particularly those relating to a person's age, ensure that the regulations are interpreted and applied consistently. Additionally, the amendments to Schedule 3 clarify that a person's age for the purpose of the schedule is to be calculated based on the exact age in days. For breaches of the amended regulations, there are potential civil and criminal consequences. Although the Explanatory Statement does not detail specific penalties, the Occupational Superannuation Standards Act 1987 generally provides for enforcement through the courts. Offences under the Act can result in fines, and in more serious cases, imprisonment. The penalties are determined by the severity of the breach and the discretion of the court. However, it is important to note that the specific consequences for non-compliance with the amended regulations would need to be examined in the context of the broader Act and any relevant case law.
