Overview
The Nursing Homes Assistance Regulations 1981 (Amendment) are statutory rules enacted under the Nursing Homes Assistance Act 1974, aiming to address the need for periodic updates to the financial assistance rates provided to nursing homes. The regulations were made by the Administrator of the Government of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, and came into operation on 7 May 1981. The primary policy objective of these amendments is to adjust the prescribed rates for nursing home assistance to reflect current economic conditions and to ensure that nursing homes receive adequate compensation for the care provided to patients. This amendment specifically involves updating the rates for ordinary and extensive care patients across various states and territories, ensuring that the financial support provided aligns with the costs associated with the care of nursing home residents.
Scope and Application
The Nursing Homes Assistance Regulations 1981 (Amendment), made under the Nursing Homes Assistance Act 1974, apply to entities providing nursing home services in Australia, specifically targeting the financial assistance provided to nursing home operators. These regulations set forth the prescribed rates for ordinary and extensive care patients, which are essential for determining the level of assistance and funding provided by the Commonwealth to nursing homes across various states and territories. The geographic reach of these regulations is national, as they apply to nursing homes in every Australian state and territory. The regulations stipulate specific amounts for each state and territory, which are intended to reflect the varying costs of nursing home care. Importantly, these regulations do not specify any exclusions or exemptions, meaning that all eligible nursing homes within the specified jurisdictions are subject to these financial guidelines. The application of these regulations is further extended through subordinate instruments, which may include additional rules or clarifications to ensure consistent implementation and compliance across the sector.
Key Provisions
The Nursing Homes Assistance Regulations 1981, as amended, primarily focus on adjusting financial provisions related to the Nursing Homes Assistance Act 1974. Section 2 of the legislation updates the prescribed rate mentioned in paragraph 13(1)(a) of the Act, changing it from $60.20 to $62.65. This change affects the financial assistance provided under the Act for nursing home residents. Section 3 further amends the rates specified in Regulation 6, replacing the existing table with a new set of figures for each state and territory. This new table details the weekly amounts allocated for both ordinary care patients and extensive care patients.
Under these Regulations, entities and parties governed by the Nursing Homes Assistance Act 1974 are required to adhere to the updated financial provisions. Nursing homes must ensure that their financial claims and calculations for government assistance reflect these new rates. This includes updating their internal systems and documentation to comply with the revised figures, ensuring that they are accurately applying the correct amounts when seeking financial support for their patients.
Failure to comply with the provisions of these Regulations can lead to various consequences. While the specific offences and penalties are not detailed within the text, breaches of the Act or Regulations typically attract penalties as stipulated in the primary legislation. These penalties may include fines or other civil remedies for non-compliance, reflecting the importance of adhering to the set guidelines. Additionally, persistent or severe breaches could potentially lead to more serious consequences, including criminal charges depending on the nature and extent of the non-compliance.
