Overview

The Statutory Rules 1975 No. 205, made under the Nursing Homes Assistance Act 1974, aims to amend the Nursing Homes Assistance Regulations. Enacted by the Australian Government, these regulations seek to update the list of eligible nursing homes and facilities that qualify for assistance under the Act, addressing the need to reflect current operational standards and facility changes. The regulations, notified in the Australian Government Gazette on 10 November 1975, were made by the Governor-General on the advice of the Executive Council, reflecting the legislative intent to streamline the administration of nursing home assistance by ensuring the list of approved institutions remains current and relevant.

Scope and Application

The Nursing Homes Assistance Regulations 1975, made under the Nursing Homes Assistance Act 1974, apply to nursing homes and hospitals that are listed in the Schedule of the Regulations, thereby determining eligibility for Commonwealth assistance. These regulations cover specific institutions such as Balmain Hospital's Glebe Annex in Glebe, Gippsland Geriatric Centre in Bairnsdale, Moreton Bay Nursing Care Unit in Wynnum, and Mount Lofty Senile Annex in Toowoomba. The regulations are intended to provide financial assistance to these entities for the care of elderly residents, ensuring that they meet certain standards of care and administration as outlined by the Act. The application of these regulations is limited to the specific facilities listed and their respective annexes or wards, as detailed in the amended Schedule. The scope of the Act is confined to the Commonwealth of Australia, with no explicit exclusions or exemptions noted in the provided text, although the precise eligibility criteria would be determined by the detailed provisions within the Act and its subordinate instruments.

Key Provisions

The Nursing Homes Assistance Regulations 1975, under the Nursing Homes Assistance Act 1974, introduce several amendments primarily through the Schedule 1. This regulation updates the list of facilities eligible for nursing home assistance. Specifically, it adds the Balmain Hospital—Glebe Annex in Glebe to the list of facilities (Schedule 1(a)). It also removes certain facilities from the list, such as items 6 and 10 from Part I and the word “Maternity” from items 9 and 28 (Schedule 1(b) and (c)). Additionally, it excludes the Fracture Wing from the list in item 12 (Schedule 1(d)). The regulation modifies figures and words within several items to reflect accurate and updated information. For example, it changes the figures in item 16 from “21” to “20” and updates the list of facilities from “28a, 28b, and 34” to “34, 35, 36, and 42” (Schedule 1(e) and (f)). Furthermore, the regulation introduces new facilities such as the Gippsland Geriatric Centre in Bairnsdale and removes and replaces others, like items 6 and 7 in Part III, now listing the Moreton Bay Nursing Care Unit in Wynnum and the Mount Lofty Senile Annex—Wards 1 to 6 in Toowoomba (Schedule 1(j) and (k)). The Nursing Homes Assistance Regulations 1975 impose specific obligations on the parties involved. These include ensuring that the facilities listed in the Schedule comply with the requirements set out in the Nursing Homes Assistance Act 1974. This includes maintaining certain standards of care and services to be eligible for assistance. The regulation also requires that any changes to the facilities or their services be reported and approved by the relevant authorities. These obligations are essential to maintain the integrity and effectiveness of the assistance program, ensuring that only qualified facilities receive government support. In terms of consequences for non-compliance, the Nursing Homes Assistance Regulations 1975 do not explicitly outline specific offences, penalties, or civil/criminal consequences within the text. However, under the Nursing Homes Assistance Act 1974, there are provisions for penalties related to non-compliance with regulations. Typically, such penalties could include fines, suspension of funding, or other administrative actions depending on the severity and nature of the breach. While the exact penalties are not detailed in this regulation, they are addressed within the overarching Act, ensuring that facilities and their operators understand the importance of adhering to the stipulated guidelines.
