NTC-29361 - EXEMPTION FROM HOLDING AND DISPLAYING A MARITIME SECURITY IDENTIFICATION CARD IN A PORT SECURITY ZONE
I am a Delegate of the Secretary of the Department of Home Affairs. Under regulation 6.07M of the Maritime Transport and Offshore Facilities Security Regulations 2003, I:
REVOKE notice NTC-28618 which gave exemption from holding, carrying or displaying a Maritime Security Identification Card (MSIC) to all employees, workers and contractors engaged, authenticated and approved by Flinders Ports Pty Limited (ACN 097 377 172) to perform construction activities exclusively within the specified MSIC exemption zone explicitly related to the Flinders Adelaide Container Terminal, GatewaySA Terminal Transformation Project (Gateway SA Project) as published in the Gazette (C2025G00286 on 1 July 2025); and
GIVE an exemption from holding, carrying or displaying a Maritime Security Identification Card (MSIC) to all employees, workers and contractors engaged, authenticated and approved by Flinders Ports Pty Limited (ACN 097 377 172) to perform construction activities exclusively within the specified MSIC exemption zone explicitly related to the Gateway SA Project.
This exemption applies to the specific area within the land-side restricted zone established at the Flinders Adelaide Container Terminal within the security regulated port of Port Adelaide. The MSIC exemption zone is depicted on the attached maps which forms part of this notice.
I specify this exemption is given subject to the following conditions:
- The MSIC exemption zone is the area defined within the Terminal Transformation Project works zone defined by the temporary fencing structure and must not exceed the area, referred to as the ‘Maximum Exemption Zone’, depicted on the attached maps which forms part of this notice.
- All persons to which this MSIC display, carry, hold exemption applies:
- have had their identity verified by Flinders Ports Pty Limited; and
- have completed a Flinders Ports Pty Limited site induction; and
- are issued and display a distinctive and readily identifiable ‘Gateway SA Contractor’ exemption card at all times; and
- have had their individual access to the site recorded on the Flinders Ports Pty Limited ‘Gallagher’ electronic access control system by a security guard, or recorded in a manual logbook in the event the access control system is unavailable.
- Flinders Ports Pty Limited maintains access control in accordance with the procedures contained in Flinders Ports Holdings MSIC exemption application.
- This exemption applies to the MSIC exemption zone only and that normal access controls, MSIC requirements and escorting procedures apply to any remaining port security zone within the security regulated port boundaries.
I specify this exemption is in force from the date of publication in the Gazette and remains in force until 1 December 2025, unless revoked earlier in writing.
