NTC-27646 - DECLARATION OF SECURITY REGULATED PORT – PORT OF FREMANTLE

 

 

I am a Delegate of the Secretary of the Department of Home Affairs. Under subsection 13(1) of the Maritime Transport and Offshore Facilities Security Act 2003 (the Act), I:

 

REVOKE Notice NTC-26478 which declared the Port of Fremantle as a security regulated port as published in the Gazette (C2024G00266, 10 May 2024); and

 

DECLARE that the area of the port of Port of Fremantle intended for use either wholly or partly in connection with the movement, loading, unloading, maintenance or provisioning of security regulated ships, the boundaries of which are shown on the attached maps, to be a security regulated port.

 

This Notice commences upon publication in the Gazette.

Overview

The Maritime Transport and Offshore Facilities Security Act 2003 was enacted to establish a framework for the security of maritime transport and offshore facilities, addressing the need to protect Australia's maritime interests and infrastructure from security threats. This Act was introduced by the Commonwealth Parliament to provide for security measures and compliance requirements for ships and offshore facilities. Scope and Application

The Maritime Transport and Offshore Facilities Security Act 2003 (Cth) applies to all persons, vessels, offshore facilities, and their operators involved in the maritime transport sector within Australia. This includes vessels that are intended for use in connection with the movement, loading, unloading, maintenance, or provisioning of security-regulated ships, as well as offshore facilities, such as oil and gas platforms, that are involved in the production of goods or services offshore. The Act covers activities that take place in Australian waters, including the internal waters, territorial seas, and the Australian contiguous zone and exclusive economic zone. The Act is administered by the Secretary of the Department of Home Affairs, and its application may be extended or restricted through subordinate instruments such as regulations and notices. For example, the Act includes provisions for the declaration of security-regulated ports, which are areas of a port intended for use in connection with the movement, loading, unloading, maintenance, or provisioning of security-regulated ships. The Act does not apply to vessels that are exclusively used for pleasure or recreation, nor does it apply to offshore facilities that are not involved in the production of goods or services offshore. Additionally, the Act includes certain exemptions and exclusions, such as for vessels that are less than 500 gross tonnage and for offshore facilities that are less than 100 metres in length.

Key Provisions

The Maritime Transport and Offshore Facilities Security Act 2003 (the Act) contains several key sections relevant to the declaration of a security regulated port. Under section 13(1) of the Act, a delegate of the Secretary of the Department of Home Affairs can revoke or declare a port as a security regulated port. This authority was exercised in Notice NTC-27646, which revokes the previous declaration of the Port of Fremantle as a security regulated port (Notice NTC-26478) and re-declares specific areas within the port for the movement, loading, unloading, maintenance, or provisioning of security regulated ships. This re-declaration is effective upon publication in the Gazette and includes specific geographic coordinates delineating the boundaries of the newly designated security regulated port. The Act imposes several obligations on entities operating within a security regulated port. These include compliance with security regulations, which may encompass measures such as conducting security assessments, implementing security plans, and ensuring that personnel are trained in security procedures. The specific security measures and protocols will be detailed in the security plan approved by the Secretary under section 12 of the Act. Additionally, entities must maintain records and documentation as required by the Act, and cooperate with inspections and audits conducted by authorised officers to ensure compliance with security regulations. Breaching the obligations under the Act can lead to significant penalties. Under section 200 of the Act, individuals and entities found guilty of contravening the Act can be subject to criminal penalties. For individuals, the maximum penalty can include imprisonment for up to 10 years, a fine of up to $210,000, or both. For entities, the maximum penalty can include fines of up to $1,050,000 for individuals acting on behalf of the entity, and up to $10,500,000 for the entity itself. In addition to criminal penalties, breaches of the Act can also result in civil consequences, such as injunctions or orders to remedy non-compliance, under section 201 of the Act. These provisions underscore the importance of strict adherence to the security regulations outlined in the Act to avoid severe legal repercussions.
