Overview

The Copyright Act 1968 was enacted by the Parliament of Australia to address the need for a comprehensive legal framework governing copyright in Australia. This Act establishes the rights of copyright owners, provides mechanisms for the use of copyrighted material, and sets out the exceptions and limitations to copyright protection. The Act aims to strike a balance between the rights of copyright owners and the public interest in access to creative works. The Commonwealth of Australia, through the Classification Branch of the Department of Infrastructure, Transport, Regional Development and Communications, intends to use short clips from various computer games in an online training course for classification services. This use is in line with section 183(4) of the Act, which allows for the use of copyright material by the Commonwealth for certain purposes. The notice serves to inform copyright owners of the intended use and to comply with the legal requirement to provide such notification.

Scope and Application

The Notification under section 124 of the Copyright Regulations 2017 applies to the use of copyright material for the services of the Commonwealth, specifically by the Classification Branch of the Department of Infrastructure, Transport, Regional Development and Communications. The notice pertains to the use of short clips from various computer games in an online classification training course aimed at government and industry clients. This use is permitted under section 183 of the Copyright Act 1968, which allows the Commonwealth to use copyright material for non-commercial research or study, for statistical purposes, or for the purpose of reporting on government or industry activities. The notice informs the copyright owners of the intended use of their material by the Commonwealth and lists the titles, publishers, and duration of the clips involved. The scope of the Act extends to the Commonwealth's communication of these clips within the training course, which is designed to facilitate classification training for various stakeholders under the National Classification Scheme. The notice does not specify any exclusions, exemptions, or thresholds, and it does not extend or restrict application through subordinate instruments.

Key Provisions

The primary sections of the Copyright Regulations 2017 that apply to this notice are sections 124 and 183. Section 124 mandates that the Commonwealth must provide notification to copyright owners when using their material for specific purposes. In this instance, the Commonwealth is using short clips from various computer games for a training course provided by the Classification Branch. Section 183 of the Copyright Act 1968 allows the Commonwealth to use copyright material for its services without requiring permission from the copyright owner, provided that notice is given. This notice serves to inform the copyright owners of the specific use of their material in the online training course. The obligations imposed on the Classification Branch under this notification include ensuring that they accurately identify and list the titles of the computer games and the corresponding publishers and programmers. They must also specify the duration of each clip used. This transparency is crucial for maintaining the integrity and legality of the training course and for upholding the rights of the copyright owners. Additionally, the notice must be provided in a manner that allows the copyright owners to review the use of their material and potentially raise any objections or seek further clarification. Failure to comply with the requirements of sections 124 and 183 of the Copyright Regulations 2017 may result in legal repercussions. The Commonwealth could face civil actions from copyright owners who feel that their rights have been infringed. Furthermore, under section 183(6) of the Copyright Act 1968, the Commonwealth could be liable for damages if it fails to provide the requisite notice. The specific penalties for breaches of these sections are not explicitly detailed in the notice but generally include fines and potential court orders to cease the infringing activity. The exact amount of penalties would depend on the discretion of the court, taking into account the nature and extent of the infringement.
