Overview

The Copyright Regulations 2017, a legislative instrument under the Copyright Act 1968, were enacted to address the need for clear and efficient communication regarding the use of copyright material by the Commonwealth, particularly for specific services and governmental purposes. This notice is issued under section 183 of the Copyright Act 1968, which allows the Commonwealth to use copyright material for services provided by the Commonwealth, with the requisite notification to the copyright owners. The policy objective behind this is to ensure transparency and compliance with copyright laws while facilitating the Commonwealth’s operational requirements, such as the Classification Branch's provision of classification training to industry stakeholders. This notice specifically informs the copyright owners of the use of short clips from a number of films in an online film classification training course, which is crucial for the Classification Branch’s role in supporting the National Classification Scheme.

Scope and Application

The Notification under section 124 of the Copyright Regulations 2017 informs copyright holders of the Commonwealth’s use of their material for the services of the Commonwealth, as stipulated under section 183 of the Copyright Act 1968. This notice specifically pertains to the use of short film clips by the Classification Branch of the Department of Communications and the Arts for an online film classification training course. The Classification Branch provides this essential training to various stakeholders, including government entities and industries such as film, television, and computer games. This training is mandatory for these industries to participate in self-assessment schemes under the National Classification Scheme. The notice serves to notify the copyright owners about the specific use of their material, ensuring transparency and compliance with copyright laws. The notice includes detailed information about the films, including the title, producer(s), director(s), production company, and duration of the clips used.

Key Provisions

Under section 183(1) of the Copyright Act 1968, the Commonwealth, through the Classification Branch of the Department of Communications and the Arts, is permitted to use copyrighted material for the services of the Commonwealth, provided certain conditions are met. This specific notice under section 183(4) of the Act is intended to inform copyright holders that the Commonwealth will be using short clips from a number of films in an online film classification training course. The films listed include "Appetites," produced by Production Inc., directed by Daniel Frisch and Cameron Casey, with a duration of 1 minute and 26 seconds. The obligations imposed by this legislation require the Classification Branch to communicate with copyright owners about the intended use of their material in a government-run training course. This communication ensures transparency and compliance with the Act. The Classification Branch must provide detailed information about the specific copyright material, including the title of the film, the producer(s), the director(s), and the production company, along with the duration of the clips to be used. These details are crucial for the copyright owners to understand precisely how their material will be utilised. Failure to comply with the notice requirements under section 183(4) can result in legal consequences. While the specific offences and penalties are not detailed in the provided text, breaches of the Copyright Act can generally lead to civil actions for infringement and potential criminal penalties. Civil actions may include claims for damages or an injunction to prevent further use of the copyrighted material. Criminal penalties could encompass fines and imprisonment, depending on the severity of the infringement. The maximum penalties for copyright infringement under the Copyright Act can vary, but they can include significant fines and imprisonment terms for wilful infringement.
