Overview

The Radiocommunications Act 1992 was enacted by the Parliament of Australia to establish the legal framework governing the use of radiocommunications in Australia. This Act addresses the problem of ensuring efficient and effective management of radio spectrum, aiming to balance the interests of various stakeholders, including the government, industry, and the public. The policy objective of the Act is to promote the safe, efficient, and economic use of radiocommunications while also ensuring that the spectrum is available for new and emerging technologies. The Australian Communications and Media Authority (ACMA) plays a key role in administering this Act, including the development and implementation of plans such as the Radiocommunications Spectrum Conversion Plan (2.5 GHz Mid-band Gap) 2012. This notice under section 43 of the Act facilitates public access to the Conversion Plan, ensuring transparency and enabling stakeholders to obtain necessary information regarding the spectrum conversion process.

Scope and Application

The Radiocommunications Act 1992 applies to any person or entity that engages in radiocommunications within Australia, encompassing the licensing, regulation, and oversight of radiocommunication activities. This legislation has a national reach, extending its jurisdiction across all states and territories within the Commonwealth of Australia. It regulates the allocation and use of radiocommunication spectrum, which is vital for a wide range of industries including telecommunications, broadcasting, maritime, aviation, and defence. The Act provides a framework for the Australian Communications and Media Authority (ACMA) to manage spectrum use, issue licences, and enforce compliance with radiocommunication standards. Although the Act itself outlines the broad scope of its application, specific details and operational guidelines are often elaborated through subordinate instruments, which can extend or clarify the primary provisions of the Act. The notice under section 43 of the Act highlights a specific instance where the ACMA has prepared a detailed plan for the conversion of spectrum in the 2.5 GHz mid-band gap, making it accessible for review and purchase, thereby facilitating compliance and transparency in spectrum management.

Key Provisions

The Radiocommunications Act 1992, specifically in relation to section 43(1), requires the Australian Communications and Media Authority (ACMA) to notify the public that the Radiocommunications Spectrum Conversion Plan (2.5 GHz Mid-band Gap) 2012 (the Conversion Plan) has been prepared. Section 43(1) mandates that this notice be given to inform the public where a copy of the Conversion Plan can be accessed. According to the notice, the Conversion Plan is available for free download from the ComLaw website (http://www.comlaw.gov.au/Details/F2012L02542), and print copies can also be purchased from the same website. This ensures that stakeholders have access to the plan detailing the conversion of the radiocommunications spectrum in the 2.5 GHz mid-band gap. The obligations imposed by the Act on the ACMA include the preparation and publication of the Conversion Plan, as well as ensuring that it is accessible to the public both electronically and in print. The ACMA is also required to provide a means for the public to seek further information or clarification regarding the Conversion Plan. This includes establishing contact details for inquiries, which are provided as the Manager, Spectrum Outlook and Review at the ACMA, with a PO Box and email address available for this purpose. By providing these details, the ACMA ensures that any questions or concerns about the Conversion Plan can be addressed effectively. In terms of compliance and consequences, the Act does not explicitly detail offences or penalties for non-compliance with the notification requirements. However, the ACMA's role in preparing and disseminating the Conversion Plan is critical for ensuring that stakeholders are informed and can comply with any future regulations or requirements related to the 2.5 GHz mid-band gap. Failure to adequately fulfill these obligations could potentially lead to regulatory scrutiny or enforcement actions under other sections of the Radiocommunications Act 1992, although specific penalties are not outlined in this particular notification. Ensuring that the Conversion Plan is readily accessible and that inquiries are promptly addressed is key to maintaining compliance and transparency in spectrum management.
