Overview

The Student Financial Supplement Scheme (SFSS) Notification under the Social Security Act 1991 and the Student Assistance Act 1973 was enacted to provide guidelines for the repayment incomes and rates for the financial year 1 July 2014 to 30 June 2015. This notification was issued by the Department of Social Services, and its purpose is to specify the applicable percentage rates for repayment income within the Student Financial Supplement Scheme, thereby ensuring that the financial assistance provided aligns with the income levels of the recipients. The policy objective is to maintain fairness and equity in the distribution of student assistance by implementing a structured repayment system based on the income thresholds set forth in the relevant acts. The notification outlines the repayment rates in accordance with subsection 12ZLC of the Student Assistance Act 1973 and subsection 1061ZZFD of the Social Security Act 1991. For instance, recipients with a repayment income below $53,345 are not subject to any repayment, while those with incomes ranging from $53,345 to $65,497 are required to repay 2.0% of their income. As income increases further, the repayment rates escalate to 3.0% for incomes between $65,498 and $92,970, and 4.0% for incomes of $92,971 and above. This tiered approach ensures that the repayment burden is proportionate to the income level of the recipients.

Scope and Application

The notification pertains to the repayment incomes and rates applicable to the Student Financial Supplement Scheme (SFSS) for the financial year 1 July 2014 to 30 June 2015, under the Social Security Act 1991 and the Student Assistance Act 1973. This legislation applies to individuals who are recipients of student financial assistance and who are subject to the SFSS, where their income is subject to repayment calculations. The specified repayment income ranges and corresponding percentage rates apply to the calculation of repayments owed by beneficiaries of student assistance, thereby impacting their financial obligations. This Act applies on a national level, governed by the Commonwealth, and extends its influence across all states and territories of Australia. The application of this legislation is primarily concerned with the financial management and support mechanisms for students in tertiary education, ensuring that income thresholds and repayment rates are clearly defined and uniformly enforced. The notice does not explicitly state any exclusions, exemptions, or thresholds beyond those mentioned, and any further details on application and enforcement may be outlined in subordinate instruments or regulations.

Key Provisions

The main operative sections of the notification are subsections 12ZLC of the Student Assistance Act 1973 and 1061ZZFD of the Social Security Act 1991, which detail the repayment incomes and rates for the Student Financial Supplement Scheme (SFSS) for the financial year 1 July 2014 to 30 June 2015. According to these subsections, the repayment income is categorised into specific ranges, each with a corresponding percentage rate that must be applied. For example, if the repayment income is below $53,345, the percentage rate is nil. For incomes between $53,345 and $65,497, the rate is 2.0%, and for incomes between $65,498 and $92,970, the rate is 3.0%. For incomes of $92,971 and above, the rate is 4.0%. The obligations imposed by this notification are primarily on the Department of Social Services and the entities involved in the Student Financial Supplement Scheme. The Department of Social Services must ensure that the correct repayment rates are applied based on the income ranges specified. Recipients of the SFSS are required to accurately report their income to avoid discrepancies in the repayment amounts. Financial institutions or employers who are obligated to report income for the purposes of the SFSS must provide accurate and timely information to the Department. Any failure to comply with the repayment income and rate provisions could result in various consequences. While the notification does not explicitly state offences, penalties, or maximum penalties, breaches of the Social Security Act 1991 or the Student Assistance Act 1973 could lead to legal action. Penalties may include fines, repayments of incorrectly received benefits, or other civil and administrative measures. In cases of deliberate or reckless breaches, criminal charges could also be considered, potentially leading to imprisonment. The exact penalties would depend on the specific provisions of the respective Acts and the circumstances of the breach.
