Telecommunications Act 1997

Subsection 56(1)

 

CARRIER LICENCE

 

I, Dominic Byrne, delegate of the Australian Communications and Media Authority, acting under subsection 56(1) of the Telecommunications Act 1997, grant a carrier licence to KernWi-Fi Pty Ltd (ACN 619 040 916).

 

Note: See Division 3 of Part 3 of the Telecommunications Act 1997 which provides for the conditions of a carrier licence and contains other provisions relating to those conditions.  The Telecommunications Act 1997 is registered on the Federal Register of Legislation which may be accessed at www.legislation.gov.au.

Overview

Under section 247 of the Act, the ACMA has the authority to impose fines and other penalties for breaches of the Act or licence conditions. The maximum penalty for a serious or repeated breach can be substantial, with fines of up to $1.1 million for corporations. In addition to financial penalties, the ACMA may also seek court orders to rectify the breach or even revoke the carrier licence if the breach is severe and ongoing. These measures are intended to ensure that carriers maintain high standards of service and compliance with regulatory requirements.
