Overview

The Telecommunications Act 1997 was enacted by the Parliament of Australia to provide a comprehensive framework for the regulation of telecommunications services and infrastructure in the country. It was introduced to address the need for a modernised and streamlined approach to regulating the telecommunications industry, which had previously been governed by a patchwork of separate laws and regulations. The policy objective of the Act is to foster competition and innovation in the telecommunications sector while ensuring that services are accessible, efficient, and of high quality for all Australians. This piece of legislation empowers the Australian Communications and Media Authority (ACMA) to issue carrier licences, such as the one granted to Core Fibre Networks Pty Ltd in this gazette. The carrier licence enables the company to provide telecommunications services under the terms and conditions set out in the Act. The Act’s regulatory framework aims to promote the development of telecommunications infrastructure, including the deployment of high-speed broadband networks, while protecting consumers’ rights and interests. The Act also seeks to ensure that the telecommunications sector operates in a fair and competitive manner, with appropriate safeguards to prevent anti-competitive behaviour and protect the public from harmful content.

Scope and Application

The Telecommunications Act 1997 applies to entities that seek to provide telecommunications services in Australia, including the provision of infrastructure such as telecommunications networks and the operation of telecommunications services. Specifically, the Act applies to Core Fibre Networks Pty Ltd, which has been granted a carrier licence to engage in the provision of telecommunications services. This Act operates on a Commonwealth level and its provisions extend to the entire nation, impacting various industries and entities involved in telecommunications. The issuance of a carrier licence under this Act is subject to conditions outlined in Division 3 of Part 3 of the legislation, which includes stipulations on service provision, quality standards, and regulatory compliance. Notably, the Act does not specify exclusions or exemptions in this instance but relies on the broader conditions and terms set forth in the legislation and any subordinate instruments to govern the licensed activities of Core Fibre Networks Pty Ltd.

Key Provisions

The primary sections of the Telecommunications Act 1997 that pertain to the granting of a carrier licence are found in Division 3 of Part 3 (subsections 56(1) and following). Section 56(1) specifically authorises the Australian Communications and Media Authority (ACMA) to grant a carrier licence to an eligible entity, such as Core Fibre Networks Pty Ltd, allowing them to provide telecommunications services. The conditions attached to this licence are outlined in the same division, specifying the terms and constraints under which the licensee can operate. These conditions may include technical standards, service quality requirements, and obligations to provide access to telecommunications infrastructure. The obligations imposed by the Act on the licensee, Core Fibre Networks Pty Ltd, include compliance with the specified licence conditions, adherence to any further regulations or guidelines set by the ACMA, and maintaining records that demonstrate compliance with these obligations. The licensee is also required to provide timely and accurate reports to the ACMA as may be requested, ensuring transparency and accountability in the provision of telecommunications services. Additionally, the licensee must ensure that their operations do not interfere with other telecommunications services and must act in a manner that is consistent with the public interest. Breach of any of the conditions outlined in the carrier licence, or failure to meet the obligations set forth in the Act, may result in enforcement actions by the ACMA. The Act provides for both civil and criminal penalties for non-compliance. Civil penalties can include fines up to $50,000 per offence for individuals and significantly higher amounts for corporations. Criminal penalties may also apply, with maximum fines of up to $2.5 million for corporations and $500,000 for individuals, alongside potential imprisonment terms. These stringent measures are intended to ensure that telecommunications services are provided in a manner that is both compliant with legislative requirements and in the best interests of the public.
