Overview

The Telecommunications Act 1997 was enacted to regulate the telecommunications industry in Australia, ensuring efficient and effective communication services are available to the public. This legislation was introduced to address the need for a comprehensive legal framework governing the telecommunications sector, which was becoming increasingly complex with the advent of new technologies and services. The Act was passed by the Commonwealth Parliament with the policy objective of facilitating the development of a competitive telecommunications market while protecting consumers' interests. The Australian Communications and Media Authority (ACMA), established under this Act, plays a crucial role in regulating the sector, including the issuance of carrier licences to service providers. On 11 February 2013, the ACMA notified that a carrier licence was granted to Acsess Health Pty Ltd, ACN 107 850 304, under the provisions of the Telecommunications Act 1997. This action aligns with the Act’s objective to support the expansion of the telecommunications industry by authorising licensed entities to provide necessary services, thus fostering competition and innovation while ensuring compliance with regulatory standards.

Scope and Application

The Telecommunications Act 1997, specifically under subsection 56(3), mandates that the Australian Communications and Media Authority must provide notification of the grant of a carrier licence. This requirement ensures transparency and public awareness regarding the entities authorised to operate within the telecommunications sector. In this instance, the Act applies to Acsess Health Pty Ltd, ACN 107 850 304, which has been granted a carrier licence as of 11 February 2013. The Act's jurisdiction is national, extending across the Commonwealth of Australia, and it applies to entities engaged in telecommunications services. While the Act broadly governs the telecommunications industry, specific exclusions and exemptions are defined within the Act itself or through subordinate instruments, ensuring a structured approach to licensing and regulatory compliance.

Key Provisions

The Telecommunications Act 1997, specifically subsection 56(3), provides the framework for the Australian Communications and Media Authority (ACMA) to notify the public of the grant of a carrier licence to a telecommunications carrier. Under this provision, ACMA announced on 11 February 2013 that it had granted a carrier licence to Acsess Health Pty Ltd, ACN 107 850 304. This notification is a formal announcement that the company has been recognised as a telecommunications carrier and is legally permitted to offer telecommunications services. The granting of a carrier licence under subsection 56(1) of the Act imposes specific obligations on the licence holder, Acsess Health Pty Ltd, to comply with various conditions and requirements. These include adhering to the standards and regulations set by ACMA, ensuring the provision of telecommunications services is within the legal framework, and maintaining the quality of service as stipulated by the Act. The licence holder must also keep accurate records of their operations and make these available for inspection by ACMA upon request. Failure to comply with the terms and conditions of the carrier licence can result in various civil and criminal consequences. Under the Telecommunications Act 1997, breaches of the licence conditions may lead to penalties, including fines and potential revocation of the licence. The maximum penalties can vary depending on the severity of the breach, with significant fines and criminal charges possible for more serious infractions. Such consequences underscore the importance of adhering to the regulatory requirements to avoid legal repercussions.
