As required by section 49 of the Electoral Act, the following tables provide details of the statistical information supplied by the Australian Statistician, the adjustments made to the statistical information supplied by the Australian Statistician, calculations involved in arriving at those adjusted numbers, and the calculations involved in the making of the determination of the number of members of the House of Representatives to be chosen in the States and Territories at a general election. 

  1. Reference date

The 2019 federal election was held on Saturday 18 May 2019.

In the 46th Parliament, the first meeting of the House of Representatives was held on Tuesday 2 July 2019.

The reference day is Friday 3 July 2020.


2.      Number of the people of the States and Territories as ascertained by the Electoral Commissioner

This ascertainment has been made using statistics supplied to the Electoral Commissioner by the Australian Statistician on 18 June 2020 in accordance with section 47 of the Electoral Act.  The information supplied is reproduced in Tables 11 and 12.

3.      The population quota

To determine the number of members of the House of Representatives each state and territory is entitled to, the Electoral Commissioner is required to calculate the population quota using the following formula:

4.      Number of members for the states

To calculate the number of members of the House of Representatives for a state, the ascertained number of people of the state is divided by the population quota, and the result rounded to the nearest whole number.

 2) Section 24 of the Commonwealth of Australia Constitution Act specifies the requirements for the composition of the House of Representatives, requiring that ‘… five members at least shall be chosen in each Original State’. Original States are defined in section 6 as meaning ‘… such States are parts of the Commonwealth at its establishment’.  As Tasmania is an Original State, it is guaranteed a minimum of five members of the House of Representatives.

To calculate the number of members of the House of Representatives for a state, the ascertained number of people of the state is divided by the population quota, and the result rounded to the nearest whole number.

6.      Adjustments for the Australian Capital Territory to incorporate Norfolk Island

Pursuant to sub-section 48(2C) of the Electoral Act, as Norfolk Island is not entitled to a member of the House of Representatives, the population is added to the population of the Australian Capital Territory and the number of members of the House of Representatives to which the Australian Capital Territory is entitled is recalculated.  See Tables 6 and 7.

7.      Adjustments for the Northern Territory to incorporate Christmas Island and Cocos (Keeling) Islands

Pursuant to sub-section 48(2C) of the Electoral Act, as the Territory of Cocos (Keeling) Islands and the Territory of Christmas Island are not entitled to a member of the House of Representatives, the populations of both are added to the population of the Northern Territory and the number of members of the House of Representatives to which the Northern Territory is entitled is recalculated.  See Tables 8 and 9.

8.      Adjustments for the Australian Capital Territory and Northern Territory

Where the number of members of the House of Representatives to which the Australian Capital Territory is entitled is equal to a whole number (known as the ‘relevant whole number’) and a remainder that is less than or equal to one-half of the population quota, sub-section 48(2E) of the Electoral Act specifies an additional calculation be performed which, under specified circumstances, will result in the ascertained population being altered which may result in the entitlement increasing. The ascertained population is altered if the following holds true:

Overview

The Commonwealth Electoral Act 1918 (the Electoral Act) was enacted to regulate the conduct of elections for the Commonwealth Parliament, including the House of Representatives, and to establish the electoral framework for the Commonwealth. The Act was introduced to address the need for a consistent and fair system of elections to ensure the democratic process in Australia. The Electoral Act is administered and enforced by the Parliament of Australia, which is the enacting body responsible for creating and amending the legislation. The policy objective of the Electoral Act is to provide a comprehensive and equitable electoral system that guarantees the right to vote and ensures the fair representation of the people in the House of Representatives. The Electoral Commissioner's determination of the number of members of the House of Representatives for each State and Territory, as detailed in the Gazette, is a critical function under the Electoral Act to maintain the integrity of the electoral process and to reflect the population distribution across Australia.

Scope and Application

The Commonwealth Electoral Act 1918 (Electoral Act) pertains to the conduct of elections for members of the Australian Parliament, specifically focusing on the House of Representatives. It applies to the whole of Australia, including the States, Territories, and external territories, and encompasses the entire population of the Commonwealth, excluding only those territories that, based on their population size, are not entitled to representation. The Act outlines the process for determining the number of members to be elected from each state and territory, based on the most recent population data provided by the Australian Statistician. This involves calculating a population quota and using it to determine the number of representatives each jurisdiction is entitled to, with additional rules for rounding and for ensuring certain territories receive a minimum number of representatives. The Act also provides for adjustments in certain circumstances, such as when territories with small populations are combined with larger territories for representation purposes. Subordinate instruments may extend the application of the Act to ensure its provisions are effectively implemented across all jurisdictions within Australia.

Key Provisions

The main operative sections of this notification pertain to the ascertainment of the number of people in the Commonwealth and its states and territories, and the determination of the number of members of the House of Representatives to be chosen at a general election in each state and territory (sections 46, 48, and 49). The Electoral Commissioner has ascertained the population figures based on statistics provided by the Australian Statistician and made adjustments where necessary (section 47). Using these figures, the Commissioner then calculates the population quota and uses it to determine the number of representatives for each state and territory (sections 46 and 48). These figures are subject to certain adjustments, particularly for territories with small populations (section 48(2A)-(2C)). Furthermore, under certain conditions, additional calculations are performed to adjust the population figures for the Australian Capital Territory and Northern Territory (section 48(2E)-(2F)). The Act imposes several obligations on the Electoral Commissioner. Primarily, the Commissioner must ascertain the population of each state and territory using the most recent statistics provided by the Australian Statistician (section 47). The Commissioner must also calculate the population quota and use it to determine the number of representatives for each state and territory, applying the rounding rules specified in the Act (section 48). Additionally, the Commissioner is required to perform additional calculations to adjust the population figures for the Australian Capital Territory and Northern Territory under certain conditions (section 48(2E)-(2F)). Breaching the provisions of the Commonwealth Electoral Act 1918 can lead to various civil, criminal, and administrative consequences. While the Act does not explicitly state penalties for non-compliance with the ascertainment and determination processes, general electoral offences under the Act can incur substantial penalties. For example, offences related to the electoral process, such as providing false or misleading information, can result in fines of up to $10,500 for individuals and $52,500 for bodies corporate, as per section 283AB. Furthermore, more severe electoral offences, such as bribery and treating, can result in imprisonment for up to three years or fines of up to $21,000 for individuals and $105,000 for bodies corporate, under sections 255 and 256. It is essential for all parties involved in the electoral process to adhere to the provisions of the Act to avoid potential legal repercussions.
