Overview

The Customs Act 1901, enacted by the Australian Parliament, serves to regulate the importation and exportation of goods, including the control and oversight of goods entering and leaving Australian borders. One of the issues the Act addresses is the need for efficient customs operations and the enforcement of customs regulations at key international points of entry, such as airports. This particular piece of legislation, C2021G00324, was introduced to revise the specified areas at Canberra International Airport where section 234AA of the Act applies. This amendment aims to ensure that customs operations are streamlined and that the enforcement of customs laws is effectively managed at the airport. By revoking the previous notice and specifying new areas, the policy objective is to enhance the effectiveness of customs regulation and facilitate smoother international trade and travel through the designated airport.

Scope and Application

The Customs Act 1901, as amended by the Gazette C2021G00324, delineates specific areas at Canberra International Airport to which section 234AA applies, superseding the previously published notice from 2016. This Act applies to all persons, entities, and transactions involving customs duties and other regulatory requirements within the designated areas at Canberra International Airport. The geographic scope of this application is confined to the specific red boundary lines as delineated in Attachment A to the Gazette notice. This legislative action ensures that the provisions of section 234AA are uniformly applied across the specified zones, maintaining compliance and enforcement standards as per the Act. The notice revokes the earlier specification and sets new boundaries, thereby refining the jurisdictional reach of customs regulation at the airport. The Act's application can be further extended or restricted through subordinate instruments, allowing for adjustments in response to operational needs or policy changes.

Key Provisions

The Customs Act 1901 (the Act) is amended through this notice (subsection 234AA(3)) to alter the areas at Canberra International Airport that are subject to section 234AA. The notice revokes a previous specification (subsection 234AA(3)) published in the Commonwealth of Australia Gazette No. C2016G01254 on 19 September 2016 and introduces a new specification, effective from the date of this notice. The areas now subject to section 234AA are those within the red boundary lines as indicated in Attachment A to this notice. This change is intended to provide clarity and precision regarding the zones where customs-related provisions apply within the airport. Under the Act, section 234AA imposes specific obligations on the areas designated by this notice. These obligations primarily pertain to customs regulations and procedures applicable within the specified airport areas. The requirements include adherence to customs laws, ensuring compliance with import and export regulations, and facilitating customs inspections and clearances as necessary. The affected areas must maintain records, report activities, and cooperate with customs officers to ensure smooth operations and enforcement of customs laws within the airport premises. Failure to comply with the provisions of section 234AA or the obligations imposed by this notice can lead to significant legal consequences. The Act includes provisions for offences related to non-compliance, which can result in both civil and criminal penalties. Civil penalties may include fines, while criminal penalties can include imprisonment, depending on the severity and frequency of the breach. The exact penalties are determined by the court, but the Act provides for maximum penalties that can be imposed for serious violations. It is crucial for all parties operating within the specified areas to understand and adhere to these requirements to avoid legal repercussions.
