In this Notice

APRA means the Australian Prudential Regulation Authority.

general insurer has the meaning given in section 3 of the Act.

Overview

The Insurance Act 1973 was enacted to provide a regulatory framework for the insurance industry in Australia, aiming to ensure that insurers operate in a manner that protects policyholders and maintains the stability of the financial system. This Act was introduced to address the need for a structured approach to the regulation of insurance activities, including the licensing of insurers, the supervision of their operations, and the enforcement of compliance with legislative requirements. The Insurance Act 1973 was enacted by the Parliament of Australia and its policy objective is to safeguard the interests of policyholders and to ensure the financial stability of the insurance industry. On 12 January 2017, a Notice was issued under the authority of Kim Simpson, a delegate of the Australian Prudential Regulation Authority (APRA), acknowledging the name change of ACE Insurance Limited to Chubb Insurance Australia Ltd, effective from 1 November 2016. This notification was made pursuant to subsection 29(3) of the Insurance Act 1973, confirming that the authorisation granted to ACE Insurance Limited under section 12 of the Act would continue to apply to the insurer under its new name, Chubb Insurance Australia Ltd, as if the authorisation had been granted under the changed name. This legal instrument ensures that the transition of the insurer's name is recognised within the legislative framework provided by the Insurance Act 1973.

Scope and Application

The Insurance Act 1973 applies to general insurers, including ACE Insurance Limited, which has been authorised under section 12 of the Act. The Act, being a Commonwealth legislation, has jurisdiction across Australia, regulating the conduct and transactions of general insurers to ensure consumer protection and financial stability. As a delegate of the Australian Prudential Regulation Authority (APRA), Kim Simpson, under the authority of subsection 29(3) of the Act, has confirmed the name change of ACE Insurance Limited to Chubb Insurance Australia Ltd, effective from 1 November 2016. This change is formally recognised through the registration of this Notice on the Federal Register of Legislation, ensuring that the authorisation granted to the insurer continues under its new name as per subsection 29(4) of the Act. The Notice itself does not specify any exclusions, exemptions, or thresholds, but the application of the Act can be further detailed through subordinate instruments, which may define specific regulatory requirements and operational standards for general insurers within Australia.

Key Provisions

The key operative sections of this Notice, under the Insurance Act 1973, include sections 29(3) and 29(4). Section 29(3) allows the Australian Prudential Regulation Authority (APRA) to be satisfied that a general insurer, in this case ACE Insurance Limited, has changed its name. Section 29(4) stipulates that the authorisation granted to the insurer under section 12 of the Act will continue to be valid even after the name change, provided the new name is registered on the Federal Register of Legislation. This ensures that the change in name does not disrupt the insurer's authorisation status and operational continuity. The Notice imposes certain obligations and requirements on the parties involved, primarily the insurer and APRA. The insurer, now operating under the name Chubb Insurance Australia Ltd, must ensure that the change of name is properly registered with the Federal Register of Legislation as mandated by section 29(4) of the Act. This registration is essential to maintain the insurer's authorisation under the Act. APRA, as the regulatory authority, is required to verify and confirm that the name change complies with the provisions of the Insurance Act 1973 and that the necessary registration is completed. This confirmation is documented in the Notice, signed by Kim Simpson, a delegate of APRA, dated 12 January 2017. Failure to comply with the requirements of the Insurance Act 1973 regarding the registration of a name change could result in various civil or criminal consequences. Although specific offences and penalties are not detailed in the Notice, general provisions of the Act may impose penalties for non-compliance. These could include fines or other civil penalties for failing to register the name change, and potentially more severe criminal penalties if the non-compliance is found to be deliberate or part of a larger pattern of regulatory violations. The exact penalties would depend on the specific nature and severity of the breach as interpreted under the Act. The Notice provides a formal record that the name change from ACE Insurance Limited to Chubb Insurance Australia Ltd is recognised under the Insurance Act 1973. It ensures that the insurer's authorisation remains valid despite the change in name, provided that the new name is duly registered on the Federal Register of Legislation. This documentation is crucial for maintaining legal compliance and operational legitimacy for the insurer in its new guise.
