Overview

The Insurance Act 1973 was enacted to establish a framework for the regulation and operation of insurance in Australia, ensuring consumer protection and maintaining the stability of the insurance industry. The Act provides for the licensing and supervision of insurance companies, including general insurers, and establishes the requirements for the authorisation and ongoing compliance of these entities. This legislation was introduced to address the need for a cohesive and structured regulatory system to manage the complexities and risks associated with insurance activities, thereby safeguarding the interests of policyholders and the broader financial system. The notice published on 28 July 2023, under the authority of Aparna Reddy, a delegate of the Australian Prudential Regulation Authority (APRA), informs the public of a change in the name of a general insurer from The North of England Protecting and Indemnity Association Limited to NorthStandard Limited. This notification, mandated by section 29(3) of the Insurance Act 1973, ensures that the legal authorisation of the insurer remains valid despite the name change, as stipulated in section 29(4) of the Act. The instrument, effective from the date of its publication, maintains the continuity of regulatory oversight and legal standing for the insurer under its new name.

Scope and Application

The North of England Protecting and Indemnity Association Limited Insurance Act 1973 applies to general insurers and their operations within Australia. Specifically, the Act pertains to entities such as The North of England Protecting and Indemnity Association Limited, which have undergone a name change to NorthStandard Limited. The Act mandates that the Australian Prudential Regulation Authority (APRA) ensures that any changes in the name of a general insurer are formally recognised and published in the Gazette. The jurisdiction of the Act is national, operating under Commonwealth legislation. The Act allows for the extension or restriction of its application through subordinate instruments, facilitating the regulatory framework for insurers to adapt to changes such as name alterations. The Act does not explicitly mention exclusions or exemptions, implying that it applies broadly to all general insurers undergoing a name change within the Commonwealth of Australia. The notice serves to officially recognise the name change and ensures continuity in the insurer's authorisation and operations under the Act.

Key Provisions

The North of England Protecting and Indemnity Association Limited Insurance Act 1973 (the Act) is a piece of legislation that governs the activities of general insurers within Australia. Section 29(3) of the Act mandates that the Australian Prudential Regulation Authority (APRA) must publish a notice in the Gazette if it is satisfied that a general insurer has changed its name. This process ensures that the public is informed of any changes to the names of general insurers, which is critical for maintaining transparency and facilitating regulatory oversight. Section 29(4) further stipulates that the authorisation granted to the insurer under section 12 of the Act will remain in effect as if it had been granted under the insurer's new name. In accordance with the Act, The North of England Protecting and Indemnity Association Limited, which operates as a general insurer under the Act, has legally changed its name to NorthStandard Limited. This change was approved by Aparna Reddy, a delegate of APRA, who is responsible for ensuring compliance with the Act. The change of name is effective from the date of publication of the notice in the Gazette, 28 July 2023. It is important for the insurer to adhere to the legislative requirements to maintain its status as a licensed general insurer. The Act imposes several obligations on the insurer, including the requirement to notify APRA of any changes to its name, structure, or business operations. This notification process is critical to ensure that APRA can continue to exercise its regulatory functions effectively. The insurer must also maintain the necessary licences and authorisations to operate as a general insurer under the Act. Failure to comply with these obligations could result in legal consequences, including the possibility of fines or the revocation of the insurer's authorisation. Under the Act, there are potential offences and penalties for non-compliance with the provisions related to name changes and other regulatory requirements. While the specific penalties are not detailed in the notice, general insurers who fail to comply with the Act may face significant legal and financial consequences. This could include fines, administrative penalties, or even the revocation of their authorisation to operate as a general insurer. Such consequences underscore the importance of adhering to the Act's requirements and maintaining good regulatory standing.
