Overview
The Special Public and Bank Holidays 2023 Territory of Christmas Island No 02/2023, proclaimed on 21 June 2023 by Farzian Zainal, Administrator of the Territory of Christmas Island, was enacted under the powers conferred by the Public and Bank Holidays Act 1972 (WA)(CI) and section 8A of the Christmas Island Act 1958. This proclamation aims to provide public holidays that reflect the cultural and religious diversity of the Territory's residents. It seeks to ensure that significant cultural and religious events are recognised, allowing residents to observe these important occasions without the burden of work or banking activities. The specified holidays include Chinese New Year, Labour Day, Hari Raya Puasa, and Hari Raya Haji, with the latter two dates being subject to change based on the sighting of the new moon in the Islamic calendar.
This proclamation addresses the need for inclusive holiday recognition within the Territory, enhancing social cohesion and providing opportunities for cultural and religious celebrations. The enacting body, the Administrator of the Territory of Christmas Island, exercised the powers under the relevant Acts to establish these holidays, aiming to foster a more inclusive and respectful community environment.
Scope and Application
The Notifiable Instrument F2023N00187, issued under the Public and Bank Holidays Act 1972 (WA) and enabled by the Christmas Island Act 1958, outlines the proclamation of special public and bank holidays in the Territory of Christmas Island. This legislation applies to all residents, employees, businesses, and government entities within the Territory of Christmas Island. It mandates the observance of specific days as special public and bank holidays, which include Chinese New Year, Labour Day, and Hari Raya Puasa, among others. The proclamation affects the operational activities of businesses and public services by designating these days as holidays, thereby influencing attendance and operational hours. The jurisdictional reach of this legislation is confined to the Territory of Christmas Island, ensuring that the designated holidays are observed and adhered to within this specific geographical and administrative area. While the Act specifies particular holidays, it also acknowledges the dynamic nature of the Islamic calendar, allowing for possible variations in the dates of Hari Raya Puasa and Hari Raya Haji based on lunar observations.
Key Provisions
The Notifiable Instrument F2023N00187, titled "Special Public and Bank Holidays 2023 Territory of Christmas Island No 02/2023", declares specific dates as public and bank holidays in the Territory of Christmas Island under the authority of the Public and Bank Holidays Act 1972 (WA)(CI). According to section 8A of the Christmas Island Act 1958, these holidays have been determined by Farzian Zainal, the Administrator of the Territory of Christmas Island. The declared holidays are: Chinese New Year (Day 1) on Monday, 23 January 2023, Chinese New Year (Day 2) on Tuesday, 24 January 2023, Labour Day on Monday, 20 March 2023, Hari Raya Puasa on Monday, 24 April 2023, and Hari Raya Haji on Wednesday, 28 June 2023. Notably, Hari Raya Puasa and Hari Raya Haji are to be observed in lieu of other dates, as detailed in the proclamation. The dates for Hari Raya Puasa and Hari Raya Haji are contingent upon the sighting of the new moon, meaning they may vary by one or two days.
The proclamation imposes obligations on the parties governed by this Act to observe these dates as special public and bank holidays. This means that businesses, schools, and government offices are expected to close, and public transportation services may be adjusted or reduced. Employees are entitled to the holiday as a day off work, with appropriate compensation as per employment agreements and industrial instruments. The observance of these holidays is intended to accommodate the cultural and religious practices of the community, fostering a sense of inclusivity and respect for diverse traditions.
In terms of enforcement, the Act does not explicitly outline specific offences or penalties for non-compliance with the designated holidays. However, failure to observe these holidays could lead to disputes regarding employee entitlements and operational disruptions. Employers who do not adhere to the public holiday provisions may face legal challenges from employees, potentially resulting in claims for lost wages or compensatory time off. Additionally, businesses that continue to operate without proper justification could be subject to public scrutiny and adverse community sentiment. While the Act does not specify maximum penalties, the consequences of non-compliance are primarily civil in nature, focusing on resolving disputes and ensuring compliance through negotiation or legal action.
