Overview
The Proclamation – Special Public & Bank Holidays 2026, issued under the Christmas Island Act 1958, designates specific days as special public and bank holidays on Christmas Island, effective from Thursday, 11 September 2025. This proclamation was enacted by Farzian Zainal, the Administrator of the Territory of Christmas Island, leveraging the powers granted under section 8A of the Christmas Island Act 1958. The purpose of this legislation is to recognise and accommodate the cultural and religious diversity of the island’s residents by declaring holidays that are significant to various communities, thus fostering social cohesion and respect for different traditions. The Public and Bank Holidays Act 1972 (WA)(CI) further enables this proclamation, aiming to provide a balanced approach to public holidays that reflects the unique demographic of Christmas Island.
Scope and Application
The Notifiable Instrument F2025N00750 issued under the Public and Bank Holidays Act 1972 (WA)(CI) designates specific days as special Public and Bank Holidays for the Territory of Christmas Island, effective from Thursday 11 September 2025. This proclamation applies to all persons, businesses, and entities operating within the Territory, and it mandates that these designated days be recognised as holidays, affecting work schedules, commercial activities, and public services. The jurisdiction of this Act is confined to the Territory of Christmas Island, a federal territory under the administration of Australia, thus its reach is limited to this specific geographic area. Notably, the Act does not specify any exclusions or exemptions, implying that all residents and businesses within the territory must adhere to the holiday regulations. The proclamation also mentions that certain dates, such as Hari Raya Puasa and Hari Raya Haji, are subject to change based on lunar observations, reflecting the dynamic nature of the Islamic calendar. This instrument underscores the legislative intent to accommodate cultural and religious observances within the territory's public holiday framework.
Key Provisions
The key operative sections of this notifiable instrument (paragraph 1) establish the determination of special public and bank holidays in the Territory of Christmas Island for the year 2026. The Administrator, Farzian Zainal, under the powers delegated to them by the Public and Bank Holidays Act 1972 (WA)(CI) and section 8A of the Christmas Island Act 1958, declares the specified dates as special public and bank holidays. These dates include Chinese New Year (Day 1 on Tuesday, 17 February 2026, and Day 2 on Wednesday, 18 February 2026), Labour Day on Monday, 23 March 2026, Hari Raya Puasa on Friday, 20 March 2026, and Hari Raya Haji on Wednesday, 27 May 2026. It is noted that the dates for Hari Raya Puasa and Hari Raya Haji are subject to change due to the lunar observation basis of the Islamic calendar.
The obligations and requirements imposed by this Act pertain primarily to the proclamation of holidays and the need to provide public notice of these determinations. The Administrator, in exercising their powers, must ensure that the public is informed of these special holidays. This notice is integral for residents and businesses in the Territory to plan accordingly, particularly given the nature of these holidays and their potential impact on public and commercial activities. The Act also requires that the dates for Islamic holidays, which are based on lunar observation, be communicated with the understanding that they may vary slightly due to the sighting of the new moon.
Regarding offences, penalties, or consequences for breach, the notifiable instrument does not explicitly state any penalties for failing to comply with the proclamation of these holidays. However, it is implicit that adherence to the declared holidays is necessary to maintain public order and to allow for appropriate observance of these significant cultural and religious events. Breaches of these proclamations could potentially lead to civil or administrative consequences if activities that contravene the spirit of observing these holidays are undertaken without proper consideration or notification. There is no mention of specific criminal penalties in the text provided, but non-compliance could result in actions taken under other relevant laws or regulations.
