Overview

The Notice of Rulings and Withdrawal issued on 9 June 2021 by the Commissioner of Taxation, Chris Jordan, under subsection 358-5(4) of Schedule 1 to the Taxation Administration Act 1953, pertains to various public rulings and a withdrawal of an earlier determination. This notifiable instrument addresses the income tax implications of specific transactions, ensuring taxpayers are aware of their obligations and entitlements in relation to particular schemes and distributions. The rulings cover a range of subjects, from major distributions by companies like Amaysim Australia Limited and Xplore Wealth Limited to the tax consequences of the W.A. Blue Gum Project 2021, providing clarity on how these events impact taxation. Furthermore, the notice also includes the withdrawal of an earlier determination concerning the car limit under section 40-230 of the Income Tax Assessment Act 1997 for the 2015-16 financial year, reflecting updates in tax policy and legislative changes. These rulings and the withdrawal aim to enhance the transparency and effectiveness of tax administration by providing clear guidance on complex tax matters.

Scope and Application

The Notifiable Instrument F2021N00114 issued by the Commissioner of Taxation, Chris Jordan, under subsection 358-5(4) of Schedule 1 to the Taxation Administration Act 1953, pertains to public rulings that address the income tax implications of specific financial transactions. The rulings apply to relevant entities and shareholders involved in these transactions. The geographic reach of these rulings is national, as they are issued by the Australian Taxation Office. The rulings cover transactions occurring within specified timeframes, such as the period from 1 July 2020 to 30 June 2021 for rulings CR 2021/40 and CR 2021/41, and from 9 June 2021 to 30 June 2031 for PR 2021/5. Additionally, the instrument also includes the withdrawal of TD 2015/16, which was effective from 10 June 2021. The rulings and determinations apply to specific entities and transactions as detailed in the notices, and their application may be further defined through subordinate instruments issued by the Commissioner of Taxation.

Key Provisions

The notifiable instrument issued on 9 June 2021 by the Commissioner of Taxation under subsection 358-5(4) of Schedule 1 to the Taxation Administration Act 1953 contains several public rulings and one withdrawn determination. The rulings include CR 2021/40 (Amaysim Australia Limited – major distribution (special dividend and return of capital)), CR 2021/41 (Xplore Wealth Limited – scheme of arrangement), and PR 2021/5 (Income tax: W.A. Blue Gum Project 2021). These rulings outline the income tax consequences for specific transactions involving the named companies and the project. CR 2021/40 applies from 1 July 2020 to 30 June 2021, CR 2021/41 also applies from 1 July 2020 to 30 June 2021, and PR 2021/5 applies from 9 June 2021 to 30 June 2031. Additionally, the instrument withdraws TD 2015/16 (Income tax: what is the car limit under section 40-230 of the Income Tax Assessment Act 1997 for the 2015-16 financial year?) with effect from 10 June 2021. The obligations imposed by these rulings are primarily informational, aiming to clarify the tax implications for taxpayers involved in the specified transactions. For example, CR 2021/40 and CR 2021/41 require taxpayers to understand the tax treatment of dividends and share disposals as outlined in the rulings, while PR 2021/5 requires entities entering into the W.A. Blue Gum Project to adhere to the tax consequences specified. The withdrawn determination TD 2015/16 no longer provides guidance on the car limit under section 40-230 of the Income Tax Assessment Act 1997 for the 2015-16 financial year, and taxpayers should seek updated or alternative guidance for that period. The notifiable instrument does not explicitly state any offences, penalties, or civil/criminal consequences for breach. However, taxpayers who do not comply with the tax obligations as outlined in these rulings may face penalties under the general provisions of the Income Tax Assessment Act 1997. For instance, failure to declare income or overclaiming deductions could result in penalties such as interest on the unpaid tax, general interest charge, and potentially prosecution for serious non-compliance. The maximum penalties for tax offences can vary widely, depending on the nature and extent of the non-compliance, and can include fines and imprisonment for criminal offences.
