The rulings were issued to provide guidance and certainty to taxpayers involved in these schemes.

Scope and Application

The Commissioner of Taxation has issued three rulings that provide clarification on specific tax matters. CR 2017/71 pertains to the Australian National University's Voluntary Early Retirement Scheme (VERS) 2017, specifically for Academic and Professional employees who receive a payment under the scheme. This ruling applies from 11 October 2017 to 30 June 2018 and will continue to apply to all entities within the specified class who entered into the scheme during the term of the ruling. CR 2017/72 and CR 2017/73 are related to the conversion of Namoi Cotton Co-operative to a company registered under the Corporations Act 2001. CR 2017/72 applies to members of Namoi Cotton Co-operative Ltd, while CR 2017/73 applies to holders of co-operative capital units in Namoi Cotton Co-operative Ltd. Both rulings apply from 11 October 2017 to 30 June 2019 and will continue to apply to all entities within the specified class who entered into the scheme during the term of the ruling. These rulings provide guidance on the tax treatment of the conversion and the implications for the involved parties.

Key Provisions

The main operative sections of the Commissioner of Taxation's Rulings (CR 2017/71, CR 2017/72, and CR 2017/73) provide guidance on the taxation implications for specific schemes. CR 2017/71 (paragraph 1) addresses the taxation of payments made to Academic and Professional employees of the Australian National University under the ANU Voluntary Early Retirement Scheme (VERS) 2017. CR 2017/72 (paragraph 2) pertains to the conversion of the Namoi Cotton Co-operative Ltd to a company and the tax treatment of its members. CR 2017/73 (paragraph 3) focuses on the holders of cooperative capital units in the Namoi Cotton Co-operative Ltd during its conversion to a company. These rulings apply initially from 11 October 2017 to 30 June 2019 and continue to apply to relevant entities who entered into the schemes during the term of the Rulings. The obligations imposed by these rulings on the parties involved include compliance with the specified tax treatments as outlined by the Commissioner of Taxation. For instance, Academic and Professional employees of the Australian National University who receive payments under the VERS 2017 must adhere to the tax implications set out in CR 2017/71 (paragraph 4). Similarly, members of Namoi Cotton Co-operative Ltd and holders of cooperative capital units must comply with the tax treatments detailed in CR 2017/72 (paragraph 5) and CR 2017/73 (paragraph 6), respectively, during the conversion to a company. Failure to comply with the provisions of these rulings may result in various consequences. While the rulings do not explicitly state specific offences, breaches of tax obligations can lead to civil or criminal penalties under the broader tax legislation. The maximum penalties can include fines and, in severe cases, imprisonment. The exact penalties depend on the nature and extent of the non-compliance, and they are governed by the general provisions of the Income Tax Assessment Act 1936 and other relevant tax laws (paragraph 7).
