Overview
The Notice of Revocation – Specified Agricultural Vehicle Notices 2023 (No.1) was enacted to address the need for streamlined regulations governing the mass and dimension exemptions for Class 1 agricultural vehicles across Australia. This legislative instrument was introduced under Schedule 1, Section 23 of the Heavy Vehicle National Law (HVNL) as applied in each participating jurisdiction, which empowers the making of instruments or decisions, including the amendment or repeal of existing notices. The revocation of specific agricultural vehicle notices, such as the South Australia Class 1 Agricultural Vehicle Mass and Dimension Exemption Notice 2019 (No.1) and the Victoria Class 1 Agricultural Vehicle Exemption Notice 2018 (No.3), is aimed at consolidating regulatory standards under the overarching National Class 1 Agricultural Vehicle and Combination Mass and Dimension Exemption Notice 2020 (No.1). This harmonisation simplifies compliance requirements for agricultural vehicle operators and ensures consistency in the application of mass and dimension exemptions across different states and territories. The notice commenced on the date of its publication and the revocation took effect 28 days thereafter, ensuring a smooth transition to the new regulatory framework.
Scope and Application
The Notice of Revocation – Specified Agricultural Vehicle Notices 2023 (No.1) pertains to the revocation of certain mass and dimension authorities for agricultural vehicles that have been rendered obsolete by the National Class 1 Agricultural Vehicle and Combination Mass and Dimension Exemption Notice 2020 (No.1). This notice applies to the South Australia Class 1 Agricultural Vehicle Mass and Dimension Exemption Notice 2019 (No.1) and the Victoria Class 1 Agricultural Vehicle Exemption Notice 2018 (No.3), which are superseded by the newer national notice. The revocation is authorised under Schedule 1, Section 23 of the Heavy Vehicle National Law as it applies in each participating jurisdiction, granting the power to amend or repeal such instruments. This notice, which may be cited as the Notice of Revocation – Specified Agricultural Vehicle Notices 2023 (No.1), commences on the date of its publication and the actual revocation of the specified notices will take effect 28 days post-publication. It is important to note that this revocation streamlines the regulatory framework by eliminating outdated state-specific notices in favour of the national exemption notice.
Key Provisions
The Notice of Revocation – Specified Agricultural Vehicle Notices 2023 (No.1) (section 5) revokes certain agricultural vehicle notices that have been superseded by the National Class 1 Agricultural Vehicle and Combination Mass and Dimension Exemption Notice 2020 (No.1). The notices being revoked include the South Australia Class 1 Agricultural Vehicle Mass and Dimension Exemption Notice 2019 (No.1) and the Victoria Class 1 Agricultural Vehicle Exemption Notice 2018 (No.3). This revocation is made under the authority of the Heavy Vehicle National Law (HVNL) as applied in each participating jurisdiction (section 2(a)).
The Act imposes specific obligations on the parties or entities governed by the revoked notices. These entities are required to comply with the new National Class 1 Agricultural Vehicle and Combination Mass and Dimension Exemption Notice 2020 (No.1) instead of the previously applicable notices. This includes adhering to the updated mass and dimension standards set forth in the new notice, which is designed to streamline and standardise regulations across participating jurisdictions.
Failure to comply with the new regulations set out in the National Class 1 Agricultural Vehicle and Combination Mass and Dimension Exemption Notice 2020 (No.1) may result in legal consequences. Although the specific penalties for non-compliance are not detailed in the notice, breaches of the HVNL can typically lead to both civil and criminal penalties. Civil penalties may include fines, while criminal penalties could involve imprisonment, depending on the severity of the breach and the jurisdiction. It is important for entities previously governed by the revoked notices to transition to the new regulatory framework within the 28-day period after the publication of this Notice (section 5(2)).
