HEAVY VEHICLE NATIONAL LAW

 

NOTICE OF RESPONSIBLE MINISTERS APPROVAL 2014 (No.  2)

 

I, RICHARD HANCOCK, Chief Executive Officer of the National Heavy Vehicle Regulator, publish this notice of approvals given by the responsible Ministers for the purposes of the Heavy Vehicle National Law (HVNL) as applied in participating jurisdictions.

 

The approvals in this notice relate to –

(a)   guidelines for granting vehicle standards exemptions;

(b)   guidelines for granting access;

(c)    the National Heavy Vehicle Accreditation Scheme (NHVAS) standards and business rules;

(d)   a class of auditors for the purposes of Chapter 8 of the HVNL; and

(e)   a standard for sleeper berths.

 

Note –

This notice is made under sections 653 and 654of the HVNL.

 

  1. Guidelines for granting vehicle standards exemptions

 

For the purposes of the definition of approved guidelines in section 5 of the HVNL, on 25 February 2014, the responsible Ministers approved the Approved Guidelines for Granting Vehicle Standards ExemptionsVersion 1.0, February 2014 (available on http://nhvr.gov.au).

 

Note –

The above approval was made under section 653(1)(b) of the HVNL.

 

2.      Guidelines for granting access

 

For the purposes of the definition of approved guidelines in section 5 of the HVNL, on 25 February 2014, the responsible Ministers approved the Approved Guidelines for Granting AccessVersion 1.0, February 2014 (available on http://nhvr.gov.au).

 

Note –

The above approval was made under sections 653(1)(c); (d); and (j) of the HVNL.

 

3.      NHVAS standards and business rules

 

For the purposes of the definitions of BFM standards and business rules; maintenance management standards and business rules; and mass management standards and business rules in section 457 of the HVNL, on 25 February 2014, the responsible Ministers approved the National Heavy Vehicle

Accreditation Scheme: Standards and Business RulesVersion 1.0, February 2014 (available on http://nhvr.gov.au).

 

Note –

The above approval was made under sections 654(1)(b)(ii)-(iv) of the HVNL.

 

4.      Class of auditors

 

For the purposes of Chapter 8 of the HVNL, on 25 February 2014, the responsible Ministers approved the following:

 

With regard to a mass management system and/or a maintenance management system, a class of auditor is "any auditor with the Grade of Certification HVA Auditor Certification" as certified by Exemplar Global (formally known as RABQSA).

 

With regard to Basic or Advanced fatigue management systems, a class of auditor is "any auditor with the Grade of Certification HVA Auditor Certification and the scope NHVAS Fatigue Management" as certified by Exemplar Global (formally known as RABQSA).

 

Note –

The above approval was made under section 654(1)(c) of the HVNL.

 

5.      Standard for sleeper berths

 

For the purposes of the definition of approved sleeper berth in section 221 of the HVNL, on 25 February 2014, the responsible Ministers approved the Sleeping Berth Standard for New Buses Manufactured after 31 December 2000 (available on http://nhvr.gov.au).

The above approval was made under section 654(1)(a) of the HVNL.
