Cody Wilson

Delegate of the Comptroller-General of Customs

Canberra ACT

12/07/2022

Overview

The Customs Act 1901 was enacted by the Australian Parliament to regulate the importation and exportation of goods across Australia's borders, including the valuation of imported goods for tariff purposes. The Customs Act 1901 is intended to facilitate international trade while also protecting domestic industries and collecting revenue for the Commonwealth. This particular notice, issued by the delegate of the Comptroller-General of Customs, specifies the ruling rates of exchange for various foreign currencies against the Australian Dollar for the purpose of determining the value of imported goods under the Customs Act 1901. The rates are specified for each day from 6 July 2022 to 12 July 2022, and they are to be used for ascertaining the value of imported goods under the provisions of Division 2 of Part VIII of the Customs Act 1901.

Scope and Application

The Customs Act 1901, as notified by the delegate of the Comptroller-General of Customs, Cody Wilson, specifies the rates of exchange for various currencies to ascertain the value of imported goods under Division 2 of Part VIII of the Act. This notice applies to all transactions involving imported goods where the value must be determined in Australian dollars. The specified rates apply nationally and cover a wide range of currencies from different countries including Brazil, Canada, China, and others listed in the schedule. These rates are effective from the dates indicated in the notice and are applicable for determining the value of imported goods for customs purposes. The notice does not specify any exclusions or exemptions but is subject to the overarching provisions of the Customs Act 1901, which may be further defined or modified by subordinate instruments.

Key Provisions

The Customs Act 1901, as detailed in section 161J, involves the specification of ruling rates of exchange, which are essential for determining the value of imported goods. According to this section, the delegate of the Comptroller-General of Customs, in this instance, Cody Wilson, has set forth the exchange rates for various currencies against the Australian Dollar for a week-long period, from 06/07/2022 to 12/07/2022. These rates are intended to aid in the valuation of imported goods under the Customs Act 1901, specifically within Division 2 of Part VIII. The obligations under the Customs Act 1901, as enforced by this notification, require importers to use the specified rates of exchange to calculate the value of their imported goods. This valuation is crucial for determining the applicable customs duties and taxes that must be paid upon importation. Importers must ensure that they use the correct rate corresponding to the date on which the goods were imported to accurately assess the value and associated costs. Failure to comply with the stipulated exchange rates as outlined in the Act may lead to inaccuracies in the valuation of imported goods, which can result in financial penalties or legal consequences. Although the specific penalties are not detailed in this notification, breaches of customs valuation provisions under the Customs Act 1901 can lead to significant fines and other enforcement actions. In severe cases, repeated or intentional non-compliance might result in criminal charges, including imprisonment, in addition to financial penalties.
