Overview

The Telecommunications (Consumer Protection and Service Standards) Act 1999 was enacted to provide a robust framework for consumer protection in the telecommunications industry, addressing issues such as service quality and accessibility. This Act was introduced by the Australian Parliament to ensure that consumers received fair treatment and high standards of service from telecommunications providers. One of the policy objectives of this legislation is to mandate transparency in the costs associated with providing essential services, such as the National Relay Service (NRS), which supports communication for people with hearing or speech disabilities. The Act requires providers of the NRS to notify the Minister for Broadband, Communications and the Digital Economy of the actual costs incurred in providing these services, as seen in the notice of the actual costs of providing the NRS by Australian Communication Exchange Limited and Westwood Spice Pty Ltd for the specified quarters of 2012. This notification is a demonstration of the Act's commitment to ensuring accountability and transparency in the telecommunications sector.

Scope and Application

The notice pertains to the final reconciliation of costs associated with the provision of the National Relay Service (NRS) by two specified providers, Australian Communication Exchange Limited (ACE) and Westwood Spice Pty Ltd (WWS), as required by section 96 of the Telecommunications (Consumer Protection and Service Standards) Act 1999. This Act applies to service providers involved in telecommunications services within Australia, including those that provide relay services for people with hearing or speech impairments. The Act's jurisdiction is Commonwealth, extending its application across the entire nation. The notice provides specific financial details about the costs incurred by ACE and WWS for providing the NRS Relay Service and the NRS Outreach Service, respectively, for certain quarters in 2012. This includes actual costs, variations from estimates, and the exclusion of GST from the figures provided. While the Act itself sets out the overarching framework and requirements for service standards and consumer protection in telecommunications, its application and further specifications can be extended through subordinate instruments or regulations.

Key Provisions

The key provisions of the notice under section 96 of the Telecommunications (Consumer Protection and Service Standards) Act 1999 require the NRS providers to report the actual costs of providing the NRS Relay Service and NRS Outreach Service to the Minister for Broadband, Communications and the Digital Economy. Specifically, Australian Communication Exchange Limited (ACE) and Westwood Spice Pty Ltd (WWS) are required to provide the total actual costs for two specified quarters, beginning on 1 January 2012 and 1 April 2012 respectively, and ending on 31 March 2012 and 30 July 2012 respectively. The notice outlines the actual costs incurred by each provider during these periods, as well as any variations from the previously estimated costs. The obligations imposed by the Act on the NRS providers include the timely submission of accurate cost reports to the Minister, as mandated under section 96. This ensures transparency and accountability in the funding and operation of the NRS. Additionally, the Act necessitates that these reports be made public, thereby enabling stakeholders to understand the financial dynamics and service delivery of the NRS. This transparency is critical for maintaining public trust and ensuring that the services provided are cost-effective and justified by the actual expenditures. Breaches of the requirements under section 96 could lead to civil or administrative penalties. Although the notice does not specify the exact penalties, the Act generally empowers the Minister to take action against entities that fail to comply with reporting obligations. Such actions could include fines or other corrective measures aimed at ensuring compliance with the statutory requirements. The penalties for non-compliance are intended to enforce the importance of accurate and timely financial reporting in the public interest.
