Overview

The Therapeutic Goods Act 1989 was enacted by the Parliament of Australia to provide a comprehensive regulatory framework for therapeutic goods, including medicines, medical devices, and other health-related products. This Act was introduced to address the need for consistent and effective regulation of therapeutic goods to ensure their safety, quality, and efficacy. The Therapeutic Goods Administration, operating under the Department of Health, is responsible for administering the Act. The policy objective is to protect public health by ensuring that therapeutic goods available in Australia meet appropriate standards of quality and safety. The Act encompasses various mechanisms, including the conformity assessment process, to maintain these standards. The notice of particulars of revocation of conformity assessment certificates, as exemplified in this gazette, is one such mechanism ensuring that only goods meeting the necessary standards are available in the market.

Scope and Application

The Therapeutic Goods Act 1989 applies to the regulation of therapeutic goods in Australia, encompassing a wide range of products such as medicines, medical devices, blood, tissues, and related substances. The Act is administered by the Therapeutic Goods Administration, an agency of the Department of Health within the Commonwealth of Australia, thus it has a national reach. It applies to entities that manufacture, supply, import, or advertise therapeutic goods in Australia, including corporations, individuals, and other legal entities engaged in these activities. The Act sets out requirements for the registration, evaluation, and monitoring of therapeutic goods to ensure their safety, quality, and efficacy. The Act also provides for the revocation of conformity assessment certificates, as detailed in the notice, where a certificate is no longer valid or has been requested to be revoked by the holder. Exclusions and exemptions may apply to certain goods and activities, as further specified in subordinate instruments and regulations associated with the Act.

Key Provisions

The Therapeutic Goods Act 1989, through Section 41EV, provides for the publication of particulars concerning the revocation of conformity assessment certificates. Section 41ES allows the Secretary to revoke such certificates, and the revocations are communicated in writing, as seen in the Gazette dated 11 September 2015. Specifically, the revocations listed include those held by Carern Marketing Pty Ltd (AU Q00269), Sinclair Pharma SRL (AU Q00296 and AU D00309), Qlicksmart Pty Ltd (AU Q00075/3), Compumedics Limited (AU Q00106/3), Sirtex Medical Limited (AU Q00119/4 and AU D00125/3), Atcor Medical Pty Ltd (AU Q00138/2), and Ulco Engineering Pty Ltd (AU Q00052/5). These revocations were carried out at the request of the certificate holders themselves. The Act imposes certain obligations on entities that hold conformity assessment certificates. Primarily, these entities must ensure that the therapeutic goods they market comply with the necessary standards and regulations. They are also required to maintain accurate records and promptly notify the Secretary of any issues that could affect the validity of their certificates. The revocation of these certificates likely indicates non-compliance with these obligations or other regulatory issues. Breach of the provisions in the Therapeutic Goods Act 1989 can lead to various consequences. For instance, if a conformity assessment certificate is revoked due to non-compliance, the entity involved may face penalties, including fines and potential legal action. The exact penalties are not specified in the Gazette but can include fines that are determined by the Therapeutic Goods Act or other relevant legislation. Criminal consequences might also apply if the non-compliance is deemed severe or intentional. The Act ensures that entities maintain high standards of compliance to protect public health and safety.
