Overview

The Notice of name change of authorised deposit-taking institution under the Banking Act 1959 was enacted to address the issue of updating the name of an authorised institution as per the requirements of the Act. The Banking Act 1959, which was enacted by the Parliament of Australia, governs the authorisation and regulation of authorised deposit-taking institutions in Australia, including banks and credit unions. The policy objective of this notice is to ensure that any changes to the name of an authorised institution are properly communicated to the public and that the institution's authorisation remains valid and effective under the Act. This notice serves as a formal notification to the public that mecu Limited has changed its name to Bank Australia Limited, and that the authorisation granted under the Act now applies to the new name. The enactment of this notice by Keith Chapman, a delegate of APRA, under the authority of the Banking Act 1959, ensures that the regulatory framework remains up to date and that authorised institutions can operate under their new names without any legal impediments. This notice is an important mechanism for maintaining the integrity and effectiveness of the regulatory system governing authorised deposit-taking institutions in Australia. By providing clear and formal notification of name changes, the notice helps to ensure that the public is aware of any changes to the names of authorised institutions, and that the institutions themselves can continue to operate under their new names without any legal issues.

Scope and Application

The Notice of Name Change of Authorised Deposit-Taking Institution under the Banking Act 1959 applies specifically to mecu Limited, an institution that holds an authority under section 9 of the Act, and its subsequent renaming to Bank Australia Limited. The authority in question pertains to authorised deposit-taking institutions, and this legislative notice pertains to the administrative process of updating the institution's name under the auspices of the Australian Prudential Regulation Authority (APRA). The Authority itself, which facilitates the institution's operation within the regulated banking sector, is thereby extended to the newly named entity, Bank Australia Limited, following the stipulated procedures outlined in the Act. The scope of this notice is confined to the administrative change in name, ensuring that all legal references and operational recognitions are updated to reflect the new entity name. This notice operates within the Commonwealth jurisdiction and is published in the Gazette to ensure transparency and legal continuity. No exclusions, exemptions, or specific thresholds are mentioned in this notice, and its application is direct and straightforward in accordance with the provisions of the Banking Act 1959.

Key Provisions

The main operative sections of the Notice of Name Change of Authorised Deposit-Taking Institution (C2017G00029) include sections 9 and 9B of the Banking Act 1959. Section 9 of the Act pertains to the authority granted to an authorised deposit-taking institution, while section 9B specifies the requirements for notifying the Australian Prudential Regulation Authority (APRA) of a name change. Section 9B(1)(b) allows a delegate of APRA, in this case Keith Chapman, to be satisfied that the authorised deposit-taking institution has changed its name, and section 9B(3) provides that the authority granted under section 9 will be deemed to apply to the institution with its new name after the notice of change is published in the Gazette. The obligations imposed by the Act on the parties involved in this name change are primarily centred around the notification process. The institution, mecu Limited, must notify APRA of its name change and provide the necessary documentation to satisfy the delegate of APRA, Keith Chapman, that the change has occurred. Once satisfied, Keith Chapman must issue a notice in the Gazette, as provided in section 9B(3) of the Act, which will have the effect of updating the institution's name in the authority granted under section 9 of the Act. There are no explicit offences, penalties, or consequences outlined in the Notice itself for failure to comply with the requirements of the Banking Act 1959 regarding name changes. However, failure to properly notify APRA of a name change could potentially lead to regulatory issues, as the authority granted under section 9 of the Act may not accurately reflect the institution's current name. This could result in complications with compliance, oversight, and enforcement actions by APRA. While the Notice does not specify penalties for non-compliance, it is essential for institutions to adhere to the requirements of the Act to avoid potential regulatory issues and maintain their authorisation as an authorised deposit-taking institution.
