Overview

The Veterans' Entitlements Act 1986 (VEA) was enacted to provide various benefits and compensation to Australian Defence Force veterans, their families, and dependents. The Act was introduced to address the need for comprehensive entitlements and support for individuals who have served in the ADF. The VEA is administered by the Commonwealth of Australia and aims to ensure that veterans receive the care, compensation, and recognition they deserve for their service. In 2013, the Repatriation Medical Authority (RMA), under section 196G of the VEA, announced its intention to conduct an investigation concerning the definitions of alcohol dependence and alcohol abuse, and their consequential effects, as outlined in Statements of Principles Instrument Nos. 1 & 2 of 2009. The RMA invited eligible individuals and organisations to submit written responses to aid the investigation, with submissions due by 22 November 2013. This investigation aimed to enhance the understanding and application of these definitions in the context of veterans' entitlements and compensation.

Scope and Application

The notice of investigation issued by the Repatriation Medical Authority under section 196G of the Veterans' Entitlements Act 1986 is intended to explore matters related to Statements of Principles Instrument Nos. 1 & 2 of 2009, specifically concerning the definition of alcohol dependence and alcohol abuse, and any consequential effects on factors related to these conditions. This investigation is limited to these particular contents of the Statements of Principles and applies to various stakeholders, including individuals eligible for pensions or compensation claims under the Veterans' Entitlements Act 1986 or the Military Rehabilitation and Compensation Act 2004, organisations representing veterans or related groups, the Repatriation Commission or the Military Rehabilitation and Compensation Commission, and experts with relevant field expertise. The scope of the investigation is confined to Commonwealth jurisdiction, with no specific exclusions mentioned in the notice, although it does extend to inviting submissions from various interested parties. The deadline for written submissions is set for 22 November 2013, with the first meeting for this investigation scheduled for 10 December 2013.

Key Provisions

Section 196G of the Veterans' Entitlements Act 1986 (VEA) provides the framework for the Repatriation Medical Authority (the Authority) to initiate an investigation into specific matters concerning alcohol dependence and alcohol abuse. The Authority is mandated to carry out this investigation due to the existence of grounds for such a review, as outlined in subsection 196B(7A) of the VEA. The investigation will focus on the definition of alcohol dependence and alcohol abuse, as well as any resultant effects on factors related to these conditions, as detailed in Statements of Principles Instrument Nos. 1 & 2 of 2009. The Authority is particularly interested in receiving submissions from various stakeholders to inform and enhance the investigation. The Act imposes several obligations on the parties involved in the investigation. Eligible claimants for pension or compensation under the VEA or the Military Rehabilitation and Compensation Act 2004 (MRCA), as well as organisations representing veterans, Australian mariners, members of the Forces, members of the Peacekeeping Forces, members within the meaning of the MRCA, or their dependants, are invited to submit written statements. Additionally, the Repatriation Commission or the Military Rehabilitation and Compensation Commission are required to participate, along with individuals possessing relevant expertise. These submissions are crucial for providing comprehensive insights and ensuring a thorough review of the specified matters. Failure to comply with the requirements set forth in the Act may lead to various legal consequences. Although the Act does not explicitly detail specific offences or penalties for non-compliance with the submission process, it is reasonable to infer that breaches could result in civil or administrative actions. The precise nature of these consequences might be further defined in associated regulations or guidelines, but they could potentially include orders for additional submissions, fines, or other corrective measures. The Authority, as the governing body, holds the discretion to enforce compliance through these means. The Authority will convene its first meeting for this investigation on 10 December 2013, marking the formal commencement of the review process. Persons and organisations interested in contributing to the investigation must submit their written submissions by 22 November 2013 to the specified address. The Authority provides detailed guidelines for submissions, which can be obtained from their website or by contacting the RMA Secretariat. Adherence to these guidelines is essential to ensure that submissions are considered in the investigation. The Authority’s commitment to this review underscores the importance of inclusive and expert-informed decision-making in addressing the complex issues related to alcohol dependence and abuse among veterans and related groups.
