Overview

The Veterans' Entitlements Act 1986, enacted by the Australian Parliament, provides a framework for the entitlements of veterans, including pensions and compensation. This Act was introduced to address the need for a structured approach to providing support and recognition to veterans and their families. The Repatriation Medical Authority (the Authority), pursuant to section 196G of the Veterans' Entitlements Act 1986, has given notice of an investigation into the potential relationship between SARS-CoV-2 infection, COVID-19 vaccines, and immune thrombocytopaenia. This investigation aims to explore whether these factors should be considered under Statements of Principles concerning immune thrombocytopaenia, thereby ensuring that any potential links are adequately examined for the benefit of affected veterans and their dependants. The Authority invites submissions from eligible individuals, organisations, and experts to contribute to this investigation, with all submissions due by 21 January 2022.

Scope and Application

The Repatriation Medical Authority (the Authority), under section 196G of the Veterans' Entitlements Act 1986, has announced its intention to investigate SARS-CoV-2 infection and COVID-19 vaccines as potential factors in immune thrombocytopaenia. This investigation will be conducted in the context of Statements of Principles Instrument Nos. 63 & 64 of 2017, which pertain to immune thrombocytopaenia. The Authority's investigation invites written submissions from various eligible persons and organisations, including those eligible to make a claim for pension or compensation, representatives of veterans and other relevant groups, the Repatriation Commission or the Military Rehabilitation and Compensation Commission, and individuals with relevant expertise. The Authority's first meeting for this investigation is scheduled for 15 February 2022. Submissions can be made electronically via the RMA website, by email, or by post, with all submissions required to be received by 21 January 2022. The Authority's decision to investigate these specific factors under the Veterans' Entitlements Act 1986 signifies a focus on the potential impacts of COVID-19 and its vaccines on immune thrombocytopaenia among eligible individuals. The scope of the Act applies to individuals eligible for pensions or compensation under the Veterans' Entitlements Act 1986 or the Military Rehabilitation and Compensation Act 2004, representatives of relevant groups, and experts in the field. The investigation is geographically and jurisdictionally limited to entities and individuals covered by these acts, with no specific exclusions, exemptions, or thresholds mentioned in the notice. The application of the Act may be extended or restricted through subordinate instruments, although such details are not provided in the notice. The Authority's notice under section 196G of the Veterans' Entitlements Act 1986 invites stakeholders to contribute to the investigation, reflecting the legislative intent to consider the broader implications of COVID-19 and its vaccines on immune thrombocytopaenia within the veteran community.

Key Provisions

The notice of investigation by the Repatriation Medical Authority (the Authority) under section 196G of the Veterans' Entitlements Act 1986 (VEA) focuses on exploring the potential connection between SARS-CoV-2 infection, COVID-19 vaccines, and immune thrombocytopaenia (sections 196G and 196B(7A) of the VEA). This investigation is situated within the framework of Statements of Principles Instrument Nos. 63 & 64 of 2017, which address immune thrombocytopaenia. The Authority seeks to gather comprehensive information from various stakeholders to inform its findings and recommendations. The obligations of the parties and entities governed by this notice are clear and specific. Eligible claimants under Part II or Part IV of the VEA, claimants for compensation under section 319 of the Military Rehabilitation and Compensation Act 2004 (MRCA), organisations representing veterans and their dependants, the Repatriation Commission or the Military Rehabilitation and Compensation Commission, and individuals with relevant expertise are all invited to make written submissions. These submissions must be received by the Authority no later than 21 January 2022 and can be lodged electronically via the RMA website, by email, or by post. The RMA Submission Guidelines provide detailed instructions for preparing and submitting these documents. The Authority’s first meeting to discuss this investigation is scheduled for 15 February 2022, and further assistance can be sought from the RMA Secretariat. Failure to comply with the submission requirements could potentially lead to significant consequences for the parties involved. Although the notice does not explicitly outline offences or penalties for non-compliance, it is implied that not submitting the required information may hinder the Authority's ability to conduct a thorough investigation. The absence of submissions from key stakeholders could also impact the fairness and comprehensiveness of the investigation's findings, which might subsequently affect the entitlements and compensation decisions for veterans and their families. Therefore, adherence to the submission deadlines and guidelines is crucial to avoid any adverse outcomes. In summary, the notice of investigation under section 196G of the VEA mandates specific obligations for various stakeholders to submit relevant information regarding SARS-CoV-2 infection, COVID-19 vaccines, and immune thrombocytopaenia. These submissions are critical for the Authority to conduct a thorough and fair investigation. Although the notice does not detail specific penalties for non-compliance, the importance of timely and accurate submissions cannot be overstated, as they are essential for the integrity and effectiveness of the investigation.
