Overview

The Offshore Petroleum and Greenhouse Gas Storage Act 2006 was enacted to regulate the exploration and production of petroleum resources offshore Australia, as well as the storage of greenhouse gases in offshore geological formations. This Act was introduced to address the need for a comprehensive legislative framework governing offshore petroleum activities and the management of greenhouse gas storage. Enacted by the Commonwealth Parliament, the policy objective of the Act is to ensure that offshore petroleum activities are conducted in a manner that is environmentally sustainable, economically efficient, and socially responsible. The Act provides for the granting of permits and licences for exploration and production, and establishes a regulatory regime to oversee these activities, including environmental impact assessments and compliance monitoring.

Scope and Application

The Offshore Petroleum and Greenhouse Gas Storage Act 2006 applies to entities and individuals involved in the exploration, production, and storage of petroleum and greenhouse gas in Australia's offshore areas. This legislation encompasses the granting of petroleum exploration permits, as evidenced by the recent grant to Browse E&P Pty Ltd, and governs the conditions, terms, and duration of such permits. The Act applies to offshore petroleum activities, ensuring they are conducted in a manner that balances environmental protection with economic development. The permit granted under this Act extends to a six-year period, commencing from 19 March 2008, and is specific to the re-released acreage in the Browse area. The Act's jurisdiction is federal, covering all offshore petroleum activities within Australian waters, subject to the terms set forth in the permit and any subordinate instruments that may extend or restrict its application. The permit, identified by number WA-533-P, is registered to Browse E&P Pty Ltd, and any exclusions or exemptions are defined within the permit's conditions.

Key Provisions

The Offshore Petroleum and Greenhouse Gas Storage Act 2006 (the "Act") includes a specific section (section 708) that provides details of a petroleum exploration permit granted by the Commonwealth of Australia. According to this section, a petroleum exploration permit has been granted with an effective period of six years, beginning from 19 March 2008. The permit has been issued to Browse E&P Pty Ltd, as the registered titleholder, for exploration activities in a specific offshore acreage area. This area, referred to as the "W16-6 GRAEME ALBERT WATERS" re-released area, is subject to the terms and conditions outlined in the permit. The Act imposes several obligations and requirements on the permit holder, Browse E&P Pty Ltd. These obligations include adhering to the terms and conditions of the permit, conducting petroleum exploration activities within the specified area, and ensuring compliance with all applicable laws, regulations, and guidelines related to offshore petroleum exploration. The permit holder is also required to maintain appropriate insurance coverage and submit necessary reports and documentation to the relevant authorities within the stipulated timeframes. Furthermore, the permit holder must obtain any necessary approvals or permits from other relevant government agencies before commencing exploration activities. Failure to comply with the terms and conditions of the petroleum exploration permit or the obligations imposed by the Act may result in various consequences, including both civil and criminal penalties. Under the Act, breaches of the permit conditions or other related obligations may lead to the revocation or suspension of the permit, fines, and potential legal action. The maximum penalties for specific offences or breaches are not explicitly stated in the provided text, but they can vary depending on the nature and severity of the breach. It is essential for the permit holder to adhere to the Act's provisions to avoid any adverse consequences that may arise from non-compliance.
