Overview

The Offshore Petroleum and Greenhouse Gas Storage Act 2006 was enacted to regulate the exploration, production, and storage of greenhouse gases in Australia's offshore areas. The Act was introduced to address the need for comprehensive legal frameworks governing the environmental and economic aspects of offshore petroleum activities, particularly concerning greenhouse gas emissions. This legislation is overseen by the Australian Parliament, aiming to ensure sustainable and responsible management of offshore petroleum resources while mitigating the environmental impact of greenhouse gas emissions. On 18 December 2024, the National Offshore Petroleum Titles Administrator, Graeme Albert Waters, issued a greenhouse gas assessment permit, G-20-AP, to Chevron Australia New Ventures Pty Ltd, Shell Australia Pty Ltd, and Mobil Australia Resources Company Pty Limited. This permit is effective for an initial period of six years from the grant date, facilitating the assessment and management of greenhouse gas emissions in the specified offshore areas. The grant of this permit underscores the government's commitment to balancing energy resource development with environmental protection, as outlined in the Act.

Scope and Application

The Offshore Petroleum and Greenhouse Gas Storage Act 2006 applies to the regulation and management of offshore petroleum activities and greenhouse gas storage within Australian waters, including the Commonwealth, state, and territory waters. This Act governs entities and persons involved in offshore petroleum exploration, production, and greenhouse gas storage operations. The permit granted under this Act, such as the Greenhouse Gas Assessment Permit G-20-AP, specifies the authorisation for Chevron Australia New Ventures Pty Ltd, Shell Australia Pty Ltd, and Mobil Australia Resources Company Pty Limited to undertake assessment activities for a specified duration. The permit delineates the scope of permitted activities, ensuring compliance with environmental and safety standards relevant to greenhouse gas storage operations. The permit’s geographic reach encompasses the offshore areas designated within Australian jurisdiction, and it excludes any activities not specified within the permit terms. The application of the Act may be further defined or restricted by subordinate instruments or regulations that may be issued to provide additional detail or impose specific conditions on the permit holders.

Key Provisions

The Offshore Petroleum and Greenhouse Gas Storage Act 2006 (the "Act") provides for the regulation of activities related to offshore petroleum and greenhouse gas storage. Section 734 of the Act outlines the provisions of a notice of grant of a greenhouse gas assessment permit, specifically for permit G-20-AP. The permit has been issued to Chevron Australia New Ventures Pty Ltd, Shell Australia Pty Ltd, and Mobil Australia Resources Company Pty Limited, effective for an initial period of six years from the grant date, 18 December 2024. The permit is intended to facilitate the assessment of greenhouse gas storage activities. Under Section 734 of the Act, the grant of a greenhouse gas assessment permit allows the permit holders to undertake specified activities related to the assessment of greenhouse gas storage. These activities may include geological and geophysical surveys, data collection, and analysis. The permit is registered under the titleholders mentioned and is subject to the conditions and requirements specified in the Act and the conditions attached to the permit. The permit holders are expected to adhere to these conditions to ensure that the activities are conducted safely, responsibly, and in compliance with environmental standards. The Act imposes several obligations on the permit holders. Firstly, they must ensure that all activities are conducted in accordance with the terms and conditions of the permit and any applicable regulations. This includes obtaining any necessary approvals, permits, or consents from relevant authorities. The permit holders are also required to submit regular reports to the National Offshore Petroleum Titles Administrator, Graeme Albert Waters, detailing the progress and outcomes of their activities. These reports must include information on the environmental impact, safety measures, and any incidents that may have occurred during the assessment process. Breaching the terms and conditions of the greenhouse gas assessment permit can result in various consequences, including civil and criminal penalties. Under Section 735 of the Act, the permit holder may face fines of up to $1.1 million for each offence if found guilty of contravening the Act or the conditions of the permit. Additionally, the permit may be suspended or revoked, which could significantly impact the permit holder's ability to conduct future offshore petroleum and greenhouse gas storage activities. In cases of serious non-compliance, the permit holder may also face criminal charges, which could result in imprisonment for up to five years.
