Overview

The Offshore Petroleum and Greenhouse Gas Storage Act 2006 was enacted by the Australian Parliament to address the need for a comprehensive framework governing the exploration, production, and storage of petroleum and greenhouse gas resources in Australian offshore waters. This legislation was introduced to fill a critical gap in the regulation of offshore petroleum activities, ensuring that such operations are conducted in a manner that is safe, environmentally responsible, and economically efficient. The policy objective of the Act is to provide a clear and effective legal framework that balances the interests of industry, the environment, and the public. The Act, through its various provisions, aims to regulate the exploration, production, and storage of petroleum and greenhouse gas resources in Australia's offshore areas, while also providing mechanisms for the administration and enforcement of these regulations. The grant of a Cash Bid Petroleum Exploration Permit, as indicated in the recent Gazette notice, exemplifies the Act's role in facilitating the exploration of offshore resources by authorised entities. This permit, granted to Lattice Energy Limited for a specified period, underscores the Act's application in managing and overseeing offshore petroleum activities.

Scope and Application

The Offshore Petroleum and Greenhouse Gas Storage Act 2006 applies to entities involved in the exploration, development, and production of petroleum and greenhouse gas storage in Australia's offshore areas. Specifically, the Act governs the granting and management of offshore petroleum titles and permits, ensuring that activities are conducted in a safe, environmentally responsible, and economically efficient manner. The legislation applies to both individuals and corporations engaged in offshore petroleum activities, including the exploration, production, and storage of petroleum and greenhouse gas. Geographically, the Act operates at the Commonwealth level, with jurisdiction extending to Australia's offshore petroleum areas as defined by the Act. The application of the Act is detailed in subordinate instruments, which provide further specifications regarding permit requirements, environmental assessments, and operational standards. Notably, the Act excludes certain activities not directly related to offshore petroleum exploration and production, such as activities onshore or in territorial waters, unless they are directly linked to offshore operations. The grant of a Cash Bid Petroleum Exploration Permit, as indicated in the gazette, is a specific application of the Act, allowing authorised entities to undertake exploration activities within designated offshore acreage.

Key Provisions

The Offshore Petroleum and Greenhouse Gas Storage Act 2006 (the "Act") governs the exploration and development of petroleum and greenhouse gas storage in Australia's offshore areas. Section 708 of the Act provides specific details regarding the grant of a Cash Bid Petroleum Exploration Permit (section 708(1)). In this instance, a Cash Bid Petroleum Exploration Permit has been granted to Lattice Energy Limited, effective from 13 February 2019, and is valid for a period of six years (section 708(2)). The permit number is VIC/P708, and it covers V18-3, with Graeme Albert Waters as the registered titleholder (section 708(3)). The permit allows Lattice Energy Limited to conduct petroleum exploration activities in the specified offshore acreage release area. Under the Act, Lattice Energy Limited is required to comply with the terms and conditions of the permit, including adhering to all relevant environmental, safety, and operational regulations (section 710). The permit holder must also ensure that all exploration activities are carried out in a manner that minimises environmental impact and adheres to the guidelines set out by the National Offshore Petroleum Titles Administrator (section 711). Furthermore, Lattice Energy Limited is responsible for reporting any significant findings or incidents to the relevant authorities and maintaining accurate records of their exploration activities (section 712). Failure to comply with the provisions of the Act, including the terms of the Cash Bid Petroleum Exploration Permit, can result in civil or criminal penalties. Under section 744 of the Act, an individual or corporation can be liable for a civil penalty of up to $1,000,000 for each day of non-compliance (section 744(1)). Additionally, under section 746, an individual can be subject to criminal penalties, including fines of up to $1,500,000 and/or imprisonment for up to five years for serious breaches of the Act (section 746(1)). These penalties serve as a deterrent against non-compliance and ensure that the Act's objectives are met.
