Overview

The Lands Acquisition Act 1989 was enacted to provide a framework for the acquisition of land by the Commonwealth of Australia. This legislation was introduced to address the need for a streamlined process to acquire land for public purposes, ensuring that the rights and interests of landowners are appropriately managed and compensated. The Act empowers the Commonwealth to acquire land for various purposes, including defence, infrastructure, and environmental conservation. The policy objective of the Act is to facilitate the efficient and fair acquisition of land while protecting the interests of property owners. The notice of extinguishment of an easement under the Lands Acquisition Act 1989 is a formal document issued by a delegate of the Minister for Finance and Deregulation. This document, signed by Dr. Guy Verney, Assistant Secretary of the Heritage, Environment and Land Policy Branch, Department of Finance and Deregulation, serves to formally extinguish the specified easement on particular properties. This action aligns with the overarching purpose of the Act to ensure that land acquisitions are conducted in a transparent and lawful manner, respecting the rights of all parties involved.

Scope and Application

The Lands Acquisition Act 1989, as demonstrated in the Notice of Extinguishment of an Easement, applies to the extinguishment of specific easements over certain properties in Queensland. This Act pertains to the extinguishment of an easement reserved to the Commonwealth, in this instance by deed of grant 19551020, Conveyance No. 605268535 (B34927) (Lot 1 on RP69975). The easements affected are those over Lot 12 on Survey Plan 236579, County of Stanley, Parish of North Brisbane, Queensland, Volumetric Lot 13 on Survey Plan 236579, County of Stanley, Parish of North Brisbane, Queensland, Volumetric Lot 14 on Survey Plan 236587, County of Stanley, Parish of North Brisbane, Queensland, and Volumetric Lot 15 on Survey Plan 236587, County of Stanley, Parish of North Brisbane, Queensland. The Act is issued by the Commonwealth of Australia, with Dr Guy Verney acting as a delegate of the Minister for Finance and Deregulation, and it pertains to the extinguishment of an easement under the authority granted by the Act. This legislation has a jurisdictional reach within the Commonwealth of Australia, specifically affecting the designated properties in Queensland. The Act may extend or restrict its application through subordinate instruments, but this particular notice focuses on the extinguishment of the specified easements.

Key Provisions

The key sections of the Lands Acquisition Act 1989 that apply to this notice of extinguishment of an easement are sections 123 and any relevant provisions related to the extinguishment process. Section 123(1) provides the authority for the delegate of the Minister for Finance and Deregulation to extinguish easements on certain properties. This notice specifically references Section 123(1) as the legal basis for extinguishing the easement related to the identified properties and volumetric lots. Under the Act, the acquiring authority, in this case, the Commonwealth of Australia, has the obligation to provide a formal notice of extinguishment when it decides to extinguish an easement. This notice must include the details of the properties and easements being extinguished, as well as the legal basis for the action. The notice must be signed by a delegate of the Minister, which in this instance is Dr Guy Verney, Assistant Secretary of the Heritage, Environment and Land Policy Branch in the Department of Finance and Deregulation. In terms of consequences, any party adversely affected by the extinguishment of an easement may have recourse under the Act. While the notice itself does not specify penalties for non-compliance, it is important to note that the extinguishment of easements is a legal process that must be followed as per the Act. Failure to adhere to the provisions of the Act could result in legal challenges or disputes, although specific penalties or enforcement mechanisms are not outlined within this notice. The Act as a whole provides the framework within which such challenges or disputes would be addressed, ensuring that the rights and obligations of all parties are protected under Australian law.
